84 in 40 ?????

I was stopped by a cop with a gun for speeding on a three lane caridgeway. I was doing 84 in a 40 zone.

The cop told me i would not loose my licence ( I asked several times) as I had no points and he was not doing me for dangerous driving as I was in lane 3 and there was little on the roads.

However I have looked on the net and it says over 30mph over and you are likley to be baned.

I am very worried!! I know I was speeding but a ban the first time seems a bit harsh.

any advice?

Were you given a verbal NIP or did you accept a fixed penalty notice?

I have a yellow bit of paper (NIP?) Notice of intended prosecution

Keep left except when overtaking.

If you are going to court for 84 in a 40 you will be losing you licence for a while.

The copper telling you you that you would not lose you licence was either looking to get through the day without the hassle of arguements or "clients" begging for mercy, or he was ill informed as to the current sentences being given out by magistrates for speeding.

What speed is recorded on your NIP? If it's 84, you're screwed. If the BiB has downgraded you to a FPN and recorded it as 65 or lower, then you'll be 60 notes lighter and 3 points on your licence.

ETA - just read your reply on the other thread in HSV & Monaro forum. You can expect a heavy fine and a relatively short ban. You are only being prosecuted for speeding, not dangerous driving, so be grateful for that.

Do I assume correctly that it was a temporary 40 for roadworks on a motorway?

I can't imagine how you will not be banned .... assuming the officer reported you for summons.

Can anybody suggest a name for newbies who turn up on PH, post a question with half the info missing, fail to respond to the questions and then disappear?

I had a few but when I posted them a little picture kept coming up on my post obliterating some of the letters....
