Read this this morning too. It's an interesting take on the whole murky area of unsigned NIPS as admissible/non-admissible evidence.
Fenton Bresler's conclusion, that nothing will change until/unless the relevant section of the RTA is re-drafted and made law, seems to accept the status quo - that the current law is a mess and the Yorke/Mawdesley cases have contributed nothing new towards clarifying it.
