hi all,
way to work this morning, biker splits the traffic, straight down the middle. I knew he was there, but then I was driving a shopper hatch with good visibility & great mirrors. Made me think, in my VX, rear visibity is dire.... as I reckon it must be in a lot of performance cars? wonder if any bikers here take this into account? I know it hadn't crossed my mind until today. No wonder Plod takes a dim view on filtering.

If you filter and have a Collision because some idiot has pulled out without looking, its always going to be 50/50 in both the eyes of the Police and Insurance companies.
Sorry Tony, that is not always the case. Most insurance companies will quote Powell v Moody (1966) which settled 80/20 against the rider, that was suprceded by Howe v Worsfield (1975) where it was 50/50, but there has been more recent case law on filtering which has awarded 80/20 in favour of the rider and in some cases 100% in favour of the rider.
I have just had a filtering case settle 100% in favour of the motorcyclist (£1.2 million) and there will be shortly even further case law to back this up.
The insurers always play Powell v Moody, as it will limit their losses if itis accepted, but if the brief does the job properly, then 50/50 should be the worst case scenario.

What would the police consider to be a reasonable difference in speed before it became dangerous?

I'm not a biker, sadly as the golden labradog won't fit on one but a quick question for you who are.
I'm in usual rush hour traffic in outside lane of M25. I keep a close eye on rear view mirror and if I see a bike coming on my nearside I make a slightly exaggerated movement to the right, putting offside over the white line in the hope that the biker realises I see him/her.
Is this acceptable/understandable/appreciated ?
(Oh, and it appreciated if bikers have dipped beam on rather than nothing)

t4r, yes I move over too.
This guy was going about 30mph faster.. what worried me was that I used to do it all the time. Just I didn't really see the harm - until I got a car with vis problems. Just wanted to point out to any bikers that sometimes cars GENUINELY don't always see them, even if the driver makes an effort to look !

YES! I love this behaviour and try and reward with a thumbs up!
In my car I do the same! Nothing makes you feel better on a bike than knowing a potential hazard has seen you!
Top marks, the biking world owes you a beer!

Always looks cool if you see a biker in your rear view mirror and indicate and move out of their way. Put yourself in their shoes (leathers), wouldn't it be nice if all the slow moving traffic in front of you moved voluntarily out of your way!!

The reason for asking was that I didn't really know whether it's of any great benefit or not.. Some (like Toad) put thumbs up but many don't react. I was trying to find out if thumbs up meant "thanks for trying but you didn't need to bother.." or if it was really helpful to you chaps and chapettes on two wheels.
Have a fun and safe weekend !

Interesting to know, thanks for that.
Practically, on the street as you can imagine...its an absolute nightmare situation.
Not so bad if you have witnesses but very complicated if you dont.
A couple of years back i used to commute on a Motorcyle (ZX-6) from the A40 around the M25 and down the A3.
The rush hour traffic was bad along the M25 as we all know, and i used to filter. I always remember that i would start off by driving slowly at first then speed up as it was a long journey.
Before too long, i would be travelling at a speed that i would consider to be dangerous and was obviously getting sucked into the traffic.
This is a very very dangerous senario and you really do have to exercise some restraint or it will only be a matter of time before someone pulls out in front of you.
Luckily, i no longer comute along this road.
