MORE...TALIVAN - NIP Stuff

Recently got mugged by a Talivan on the A40.....dammit!!....Now then when I got the old NIP it quoted "excess speed (40mph limit)" Aha I thought! replying that the charge for the alleged offence was incorrect as the limit at the point of the alleged offence was in fact a 50mph limit...Letter comes back saying this is immaterial. However I then send in my NIP, unsigned. Which was replied to by the good 'ol Met with a letter explaining that I had not complied and issuing another NIP for me to fill in. Now then this NIP quoted "excess speed (50mph Limit)!! A question to the resident BiB and/or gentlemen of the bar...Does this change the charge and if it does would that mean that the 28 day limit has passed?
