Wrong reg number on NIP

My father-in-law has been sent an NIP through the post for being in charge of a vehicle on a public road without MOT or insurance.

He works for a company delivering kids to a local school in a minibus thingy. Alegedly this is the vehicle, it's not his it belongs to the company. Apparently he wasn't approached by anybody, and also thinks that the exact time stated on the statement would mean he wasn't even where it says at that time in the morning.

Now this is where it gets even more confusing, although the make of vehicle (ford) is correct, the reg number on the NIP is not. They've got the numbers muddled up.

I've suggested he pleads not guilty - goes and has his day in court and when the prosecution give their statement he informs them that he's never driven vehicle reg. number blah blah blah.

This is supposing the vehicle didn't have MOT and insurance at that time (the correct vehicle that is not the one on the NIP) He's trying to find that out from the people he works for.

He can, quite honestly, return the form stating he has utterly no idea who was driving at the time.

Because he doesn't.....

I believe the court can correct 'simple' mistakes on the NIP, such as transposing numbers on the VIN, but bigger mistakes could possibly have the charge thrown out.

But I believe the reason he's got this is because the company have said he was driving. Otherwise he wouldn't have received it as the vehicle isn't registered to him.

But the vehicle named in the NIP isn't the vehicle he *might* have been driving.

He can honestly say he's never driven a White Transit minibus with the registration on the form.

Should the court notice the mistake and send a new one, then he would have to fill in *that* form correctly as well.
