More NIP stuff......sorry
Discussion
Just recieved NIP for an offence that happened last April. I have recently moved back from Germany, where my car was registered as a BFG (British forces Germany) vechical.
No doubt the paperwork has winged its way around the world to find me (very dedicated these N Wales Coppers), but the date on the form is still nearly 6 months out of date.
I wrote a snot-o-gram requesting a piccy and complaining about the date.
I recieved back an unidentifiable picture and the infomation that the original NIP was send out within 4 days.
I never recieved the original NIP, my one is massively old and the picture is crap.......anyone any suggestions what to do?

The NIP was dispatched within time. It is then valid even though it has taken over 6 months to get to you.
You may be lucky on this one as the information has to be laid within 6 months of the date of the offence. The Police cannot lay the information if they do not know who the driver was until you fill in the form and send it back. If this happens to be after the 6 month statutory limit on proceedings, then when they get the information, the summons information will be too late to put before a court for authentication.
You cannot even be summonsed for failing to notify the driver as they don't know who this is to put in the information.
If the Police enquiry has not managed to trace you within 6 months of the offence and you have no idea they were trying to do so, then you can forget about it.
Send the form back filled in with the relevant details and tell them in a letter what has happened and that you know about the statutory limit on procedings. It is not your fault they could not deliver the NIP to you within that 6 months to enable you to give them the details required to lay an information. Therefore you understand that as you have not tried to avoid the situation but merely were unaware and you will now expect them to inform you that the case has been dropped.

Right, so let me get this straight. If they cannot identify the driver within 6 months then the case cannot be followed up?
Offence was 24/4/03, i recieved 1st letter 26/8/03 (ie 4 months) then requested photo (recieved 12/9/03).
The photo is useless, i genuinely don't know if it was me or my Dad driving. If i request further info and it drags out to over the 6 month point then they should drop the case.
Am i right?

If the information about who was driving cannot be laid within 6 months of the date of the offence, then there is no summons so no case.
The rest is up to you
