Theoretical NIP question

I am in the current situation of borrowing a car from my in-laws while they are on holiday. The car is shared between myself, my wife and my sister in-law...and is pretty much on the road for most of a 16 hour day.
The question is: if the car is flashed by a camera and the NIP comes through asking the owner (my father in-law who was out of the country) to identify the driver, and no-one owns up. How does he handle it? He can't identify the actual driver, could be one of 3 people, but not him, and he can prove he was out of country at the time.....what happens? He can't reasonably identify the driver? Who gets the points?
