Gossip has it that someone locally to us (we live in a small village) was caught last week, 5 times over the drink drive limit.

Mrs Yoda and I were speculating what sort of sentence they were likely to receive... Custodial? Vast fine and multiple years ban?

(This is Scotland, btw, if that makes any difference to how the courts see things. There is definitely a 'drink culture' in the area.)

I'm not a BiB or a beak but would have thought that at five times over you must be looking at custodial

Surely there can be no argument for borderline??

I clicked on your post thinking I'd see '150mph in a 30mph zone', but sadly that wasn't the case.

I was going to say shoot the BD but as it is Scotland maybe they could head butt him instead.

Besides, not that serious a crime, now if he was doing 35mph in a 30mph.................

To give you some idea as to how bad this is...

Average blood/alcohol readings and associated condition as follows...

140-160 Unconcious
160-180 Coma
180+ Death

With a five times the limit reading (175) he should have been way past the ability to walk, let alone drive. Are we scared yet??

I would have thought most Scottish people would be at least 5 times the drink drive limit if tested

I personally know of someone who was stopped at just under SIX times over...a functioning alcoholic who JUST avoided a custodial but received a 5 year ban.

These kind of levels can easily end up being a custodial sentence, but it does depend very much on the circumstances.

I remember witnessing someone using one of those pub breatherlyser machines about 10 years ago and he registered 310. He had been drinking all day, was clearly tipsy but otherwise fine. He was a big lad.

Edited to say that I have no idea how accurate these machines are and also don't recall seeing one since that time. Maybe they were just a crock of sh1t!

Yeah not convinced of the accuracy of those machines - I used one in a club in Banff, Canada last year after drinking all night, (shots 50p a go!), playing drinking games and feeling very battered.

It read 210!!! - quote from girl stood next to me "You should be dead with that !", my reply "wow cool"

Then staggered back to the hotel in -40C got 2 hours kip and was on the plane home 6 hours later!
