Speeding penalty fluctuations

Hi all, I'm sure this is a question/topic that has been round on these boards numerous times so, apologies in advance for that but...
A close relative was recently clocked by a talivan at 94 on an empty dual carriageway (NSL). They received a NIP, signed it and sent it back (I was unable to advise her based on info from here before she did this). She pled guilty and provided a statement which was read in court and they came back with a penalty of 5 points and a £200 fine!
I couldn't believe it when I heard this. It seems way too severe to me, what are other peoples thoughts and, is there any way to appeal this at this stage?
Oh, if it makes any difference, this was her first traffic offence of any kind.

Nope. Regardless of circumstance speeding is speeding and thes do not take into account conditions. I was done for 77 in a 70 on an EMPTY dual carrageway in wales. Only reason I didnt see the van is because he was hiding on a laybay with no markings whatsoever on the front.

None whatsoever. They will penalise for bad driving but never reward or be lenient on good drivers. Numptys always win

ked off motorist who will now be against a)speed detection and possibly b) The police. They really arnt doing themselves any favours are they....

Court for 94 in a 70 seems rather excessive.
I have a theory – which may well be wrong. Last year my ex g/f got caught by a talivan at 97mph on the A449 NSL dual carriageway in Wales. She got a standard fixed penalty, 3 pts and £60 fine. My brother in laws parents (what relation are they to me?) have been pootling around in various cars for forty years and had clean licenses until a few years ago. The wife drives all the time and she is no speed demon, but she has been done for doing 10 mph over the limit when going passed a new camera on a road she has been driving on for decades quite safely.
They have been sharing the points and they both have nine points on thier license now, these people will be housebound soon, and they have just been pootling about at 40mph, like they have done for years...

youre right, but also, you are wrong. yes the public will be pissed off with the police, but the fault does not lie with them, rather the councils and i daresay the government that continue to pursue this speed kills crap.
what will happen as each generation get stitched up.
the next one will care less about doing it legaly.
a few more and no one will care and will just do as they like.
and compleatly ignor the rules.
It is basicly now inposible to do anything with out breaking the law.
the simple fact is if every one did follow the speed limets the whole contry would be at a total stand still in a very short time.
the way things are heading there will be major civl unrest.
and i firmly belive that is the only thing that will help us live a desent life.
bring on the revolution it is badly needed.
the next one will care less about doing it legaly.
a few more and no one will care and will just do as they like.

I agree with you outlaw, apart from the civil unrest bit...I think us brits will not bother to stand up and fight anymore.
We will just dodge as many of these ridiculous laws as we have to, in order to carry out our lives.

em...I will be driving an unregistered car around when i want to drive like a nutcase... No quotas for court apply. The pen-pushers are keen to get as many fixed penalties as possible. They are the quickest, cheapest and most certain way of getting money and convictions. What merits court will depend on various local factors e.g. if road has a bad record, more likely to come to court, even when the road was empty.
As for penalty, I'd said on here often enough that it is worth the effort coming along to court. Cost you a bit in lost wages etc, but you will generally get a lower penalty by virtue of being ar##d to turn up, explain the situation, and appear apologetic. Some courts expect 4-6 for no shows, but will impose only 3 if you turn up, whatever the speed.

Avon and somerset scamera muppets gave me 3pt and £60 fine for doing 71 in 50 limit on dual carriageway! Thought I was very lucky! Whilst I am definitely not saying it should have been more, shouldn't there be a national system for deciding points rather than having regional variations for fines etc.
Colleague of mine got 6pts and £500 fine for doing 93mph on a 60mph A road - in wales - guess that would be hung drawn and quartered now with bumtwit in charge!

I got stopped in 1999 for 51mph in a 30mph and the bib refused to give me a fixed penalty.
I was advised to expect 6 points and at least £150 fine.
Once it came back from the procurator, I got 3 points and (I think) a £40 fine....
My parents could not understand when I went out to celebrate....
