I received an NIP after allegedly going through a speed camera. I returned them, filled out, but unsigned. I received a reply saying I hadn't signed, I sent that back saying that if the Police could tell me where in the law I am obliged to sign I would do so. They then wrote back saying that the motoring offence is dropped but I am going to be taken to court from failure to supply information. I am not bothered about that really as I feel I can defend myself successfully, all I am wondering is what the penalty is for failure to supply info.
Anyone else been prosecuted for failure to supply info?

Lots, none successfully though, that I know of, in an 'unsigned' case.

Received a summons yet or is it just a snooty letter?

nothing as, I take it you did supplie it.

Theres no law that say you must sign it.

But if convicted the penalty is the same, 3 points and 60 quid 'contribution' I believe.

Not sure if it differs by force/region, but I have a similar situation pending and am being threatened with "3 points and up to £1000 fine" for failure to supply information!

See this is where the law has become a joke. How can you get 3 points for failing to provide information? Again we have a presumtion of guilt before any proof has been made.

I know plod doesn't make the law but in Northamptonshire they seem to have a great deal of resources for speed cameras whilst other forms of crime are dealt with less effectively. I should point out also that the majority of my council tax increase for 2003/2004 was due to the police.

Its time they took a broader and more responsible approach to something that costs the community a mint to fund.

Yep that is the potential penality. Whether an unsigned NIP fullfils the need at s172(1) RTA has not been tested in court so you may lose or you may win. But most likely they will drop it as they do not have to court time.

Also, I guess you don't even have to have a driving license to be a registered keeper on the V5?

Yup. We've discussed the idea of my very nice and rather forgetful non driving grandmother being the registered keeper for every car here.

They can give her as many points as they like.

I tried to insure a car that was registered in my girlfriend's name and a few companies would not accept it because I was not the 'keeper' although I was the owner.
I just didn't want to increase the amount of owners on the V5 especially when we live together and it would still have been registered at the same address.
What pi55ed me off was I was a named driver on the current insurance anyway..

Have any of you guys had problems with this???

So how do you get round it then...... No doubt the government won't like it due to the problems it raises with convictions and it probably just means too much hassle for the insurance companies, but when you legitimely want to insure someone elses car, (eg: using mates car for the winter when the TVR is in the garage)... how do you go about doing this without renewing the V5 in your name??

You pay up; by that I mean that you have to go to a company which allows it. Thus your choice of companies is limited, and what you pay is inevitably more. There are also some companies that do allow it, but at increased cost.

I have insured cars no problem about owner/keeper. They don't care as long as they get the dollar.

As for not signing, it works.
