I've google'd for the answer but can't find anything definative here.

Is it a legal requirement for MOT purposes to have a spare wheel or not?

99.9% certain you don't need a spare wheel wheel but if you have one it must be legal.

No it is not. It is not part of the MOT to check the legality of the spare wheel.

I know that for a fact as I checked that one out when one of my tyres failed an MOT. Putting the spare wheel on and putting the illegal tyre in the boot made the MOT pass.

Gave me the time to order the tyre from a decent place.

Absolutely not. Many performance cars are supplied without them. The later TVR's for instance are supplied only with some cans of tyre sealant (not glue to hold them together before anyone starts) ! biggrin

MINIs don't have one. At least the Cooper S doesn't. And you see a lot of them about.

Your spare tyre had passed.

Your other tyre had failed.

You put you spare on and the tyre that failed was legal.

There is no requirement to retest a satisfactory item.

Daft isn't it?

His spare hadn't passed as it is not part of the test.
Honestly, look it up. There are several MOT tester's manuals online.

Minis have run flat tyres so not much point having a spare

I recently had to unload a pile of stuff from the boot so my local MOT place could check the spare. I questioned this, and whilst it's not testable, he always notes the condition of the spare and gives an advisory if it's worn out which is fair enough.

A spare wheel with a tyre fitted does not have to be legal for the road as long as the wheel is not fitted to the axle hub and on a public road.

A car with a spare wheel in the boot with a defective tyre fitted to it will not be subject to an MOT failure as it is not part of the test.
