Purely hypothetical question you understand, however after 23 years motoring with only 6 points I have been nicked twice in 6 months. Our little man in the Van (85 in a 70 zone, 41 in a 30 zone) you understand. So at this rate this question may become a matter of fact in about 6 months.

Back to the question. Is there a fixed penalty (ban, fine, both, firing squad, etc) or is it up to the discretion of the courts as to what you get.

I have heard that its typically a 6 months ban, unless you can demonstrate that you would suffer economic hardship (lose your job). If so how does one demonstrate this, and what criteria is used.

PS Also is there an automatic band for exceeding any given speed limit by over 30mph (i.e. 100mph on a motorway - 60 in a 30 zone, etc.)

PPS Can these Vans clock your speed if you are travelling away from them on the other side of the road - according to them YES (i have a ticket to prove it), however I would welcome the views of some of the experts who access this site.

I've know some lads to still be driving with 14 and 15 points on their license. It's not automatic but it's usually a ban.

All down to the court, the judge, what way the wind is blowing, a decent barrister, etc.

Good luck and try not to get anymore points in the meantime.

Thanks Rich, my depression is now complete. I blame the technology in my car (ABS, Traction control, DSC, 200bph, etc, etc), the companies who design Gastos, Trlivans, etc, the government (mostly) and shoe companies for failing to put something in my right shoes to automatically pokes me in the balls every time a miss a sign or speed.

Ho humm must try harder I suppose :banghead

At uni I worked as a gardener.

One of the other gardeners got a 6mth totting up ban. (This was back in the days when a totting up ban meant you were a bit quicker than average.)

His solicitor pointed out the ban would mean him losing his job.

The magistrate accepted this, banned him and gave him a smaller fine to take account of the fact he would be on the dole for 6 months!!!

Pause to think about the stupidity of that!

Fortunately for him his benefits for himself + wife were very near his gardening earnings so he was able to spend time windsurfing and return to the same job after 6 months.

Nice bloke - loved his job.

Don't know how the state feels it benefited from that!

Don't know how the state feels it benefited from giving him a smaller fine and supporting him for the 6 months off work!

I've always though instead of a ban you could just simulate the ban by fining the guy income equivalent to the ban period and banning him from drivng for anything other than work...

Hi,

It is possible to keep on driving with over 12 points......I had 14 points on my licence at one point !!

I had 9 points after 3 lots of fixed penalties (ie doing 31 mph in a 30 limit, that kind of stuff) then got accused of doing 81 in a 50 limit (although it is usually a 70 limit but there was some dodgy roadworks there, so obviously an accident blackspot !!).

Anyway pleaded guilty in court, said I was self employed, would lose household income if couldn't drive etc etc etc and had a decent lawyer, and letter from company boss, and prepared a list of income/outgoings. Got 5 points, £200 fine, and no ban which I was pleased with !!

Just prepare well for it, and look remorseful, and you nay well not get banned.

Dave, fat chance - I saw your post about almost binning your MR2. Anyway you are to young to die

Although if I carry on like this I might be looking for a driver for a few months - in which case you may have use of the Beemer?

PS watch the A36 just before you get to Wilton - bastards the lot of them!!

Did you see my post about bent rear track arms? and very very dodgy camber? Because thats been diagnosed as the cause of my sideways moment! Local garage (Riverside) had a look at it and the mechanic said he could feel the back end twitching out every time he went over a bump! So i think im doing rather well NOT to have binned it yet

A36 - just BEFORE Wilton? Do you mean in between the bridges? They're there quite a lot - often on the weekends (as its jammed solid during rush hour in the week - no chance of speeding there then!). I know a few people who've been caught by the Scamera van there. Thanks for the tip though.

Mr2Mike............it wasn't exactly the boss, but someone very high up in the company we were doing business with at the time.

It was easier to say "boss" to a judge than having to go explain how ltd companies work, as he wouldn't have had a ing clue !!

A mate of mine who's a photographer (paparazzi!) for the times was always getting nicked a few years back. For driving up one way streets, parking where he shouldn't, speeding etc.

He exceeded his 12 points, and somehow convinced a court that he'd be homeless and broke without the use of his car.

He got an extension of up to 18 points. (which he used up a few weeks later!!)
