My car has been up for sale and sat in my garage for just over a month now.

The tax expired a month ago.

I havent taxed it hoping it will sell sooner now that its reduced to £350.

Questions:
1, Will I get fined for this? if so what?
2, What happens if a customer gets caught whilst test driving it?
3, Whats the best thing for me to do?

Send the SORN off to take it off road officially that way no fine,

or just give me the car, and I will sort it out for you.

Ducsty,

Cant say I blame you - I wouldnt bother in that situ either.

Tax isnt really a criminal offence (well not like no insurance), and in my experience, the police often couldnt give a toss...the DVLA, on the other hand, do. You can get fined up to a grand, but you'll almost definitely get a 30 quid fine....IF you're spotted.

Seeing as the tax only ran out recently, its very unlikely you'd get more than a 'sort your tax out mate' from any decent copper....

test-drive. Onus still entirely on you - cos the tax is vehicle linked

best thing to do. I would personally cross my fingers and hope it was okay. The legal thing to do is to go and buy tax NOW!

for info...not having tax does NOT invalidate insurance or anything - so the worst you're doing is upsetting all us good road-tax paying people....and the governement. shame

I am paying tax for the car I use everyday though and I only pay it to keep you lot happy!

Buy six months tax, sell the car, keep the disc and get a refund. Will only cost you a few quid.

Nightmare just gave me an idea...

The Gov is always going on about un-taxed cars, so why don't the insurance companies put a new clause in their policy documents:

"Policy is null and void unless the vehicle it relates to is properly taxed..."

Then just see how many cars go untaxed. Granted this doesn't account for people who don't have either tax or insurance, but it might go someway to allivieate(sp?) the problem...

Night, are you 100% sure about this? When I queried this about a car I planned to take abroad for a while I was told (by the insurance company) that the car must be road-legal for use in the UK, and that included being taxed, otherwise the insurance company may decline to pay out in the event of an accident.

Spotted a white van being driven well in excess of the speed limit on the M1 in Northamptonshire yesterday and guess whats plastered all over it... DVLA ClAMPING UNIT, could not read all the smaller print on the van but the message seemed to be something about catching untaxed cars!

absolutely definite.....(until one of the BiBs tells me Im wrong ). UK car insurance abroad will undobtedly be something they'll make an effort to wriggle out of....but it ISNT a legal thing....if Im wrong, I sincerely apologise for the bad advice.

Yes he was certainly in a hurry, was way past me when i realised what the writing on the van was all about.... one rule for them maybe or had he been called to possible untaxed car in the next town!!!!

I too was under the impression - no tax - no insurance! Might depend on your policy I guess.

Dusty you are heading for a fine for not filling in a SORN (about £25 I think). The longer you do nothing the worse the consequences. There is a case on another forum where a guy had a car off the road for a long time and they are after £3500. Best plan is to back tax it for six months, provided you still have the insurance. Otherwise SORN it but this is bound to cost you £25. Your choice, but doing nothing will get very messy.
