Friend of mine received a NIP for her car doing 94mph on a motorway many miles away from home. Assuming it could be a cloned car (I've heard eight per cent of cars are clones), I advised her to ask for photographic evidence, the police officer's statement, copies of the officer's notebook and any other observations that may help identify the car and/or its driver.

After several requests the police have replied, saying my friend may view the photos at a police station, and that any other evidence 'is a matter of Advanced Disclosure and is only available through the CPS once a court hearing has been requested'.

We didn't ask for this, but their letter also goes on to say the reading was taken with an LTS 20.20 TS/Speedscope hand-held device and Lastec Local Video recording system. They say the equipment is calibrated annually and checked prior to scamming road users, and has a certificate and statement confirming its ability to raise cash on the date in question.

Any comments, chaps? Shouldn't they send the pic, or is it okay to hold it at the station? What about the other evidence?

You can only request the "evidence" once you have pleaded not guilty and a court hearing has been set ...

You can request it any time you want. They can, of course, tell you to sod off. Some forces are more reasonable than others.

You are only entitled to it seven days before the court hearing. Even then, many CPS areas will try to prevent you getting it.

I suggest that you write back to the scammers saying that, as several people drove the car that day, that you would like to see the photograph to assist you in your efforts to identify the driver. Unfortunately, due to the distance, it is not practical to view the photograph at the police station (assuming that it is far enough away to make that a realistic statement).
