HELP!! Please could anyone offer advice.
If you are caught speeding in a 30 zone but do not receive a NIP until 5 months after, is this still valid??? Can they prosecute?? Any one know what you are likely to get for doing 53 in 30 zone with 6 points already??

I went through a similar scenario and eventually received my summons five and a half months later. My brief told me they had up to 6 months from the date of the offence to summon me. Can't condone what you did but I hope you get away with it and most importantly learn from your experience. Sermon over, sorry.

Depends on whether you are the registered owner of the vehicle at the time of the offence. If you were then you have probably got a very good case. If the car is a lease/hire car or it was around the time you bought the vehicle then you are probably still looking at it being valid.

The law is that the NIP has to be sent to the registered keeper no more than 14 days after the incident. If the driver is not the keeper then they can chase that driver for along time after the incident. Also, is the first NIP they have sent you (I don't mean that you have received) IE have the sent you a repeat notice saying something along the lines of "we have not had a reply"? In which case if the original was sent under the 14 day limit you are unlucky as well.

Your brief was not quite correct. They have six month's to lay the information before the magistrate to issue the summons. The summons can be served any time after issue, even years later if they have trouble tracking you down.
