NIP - 14 or 15 days?

I never thought that i would be starting a post about the dreaded Nip's.

I was reading through a copy of Blackstones (not Butterworths as originally stated) Police Law and came across a section about Nip's and it states that the actual time give for lawful service in the first instance is in fact 15 days...one extra day to allow for postage.

Did anyone know that?

I always thought it was 15 days including day of offence are you saying its 16 days including day of offence

15 days from date of offence is how i understand it.

We are spoilt in the MetPol because when i do a process Book or a Ticket, we submit that the same day and dont have anymore contact with it unless it goes to Court. We have Process sections who deal with all the summonses etc etc on our behalf.

As i understand it, in the County forces 'most' have to do their own..........

Tonyrec -
yep it's definately 15 days ( day one being the commission of the offence ). Do you metpol issue NIPs automatically for every NIPable offence, or do you not just suffice with a verbal if possible - we have an auto system oop north but only for RTAs

We just tend to do it the 'verbal' way but there are occasions when some people dont automatically do it at RTA's.
Weve got a new system which has been up and running now for a few months and that i9s a Central Traffic support unit. All of our reports, incl RTA's all go to the one place.
The old system was pretty poor because the reports went to the Division where the Offence was committed and 'sometimes' depending on their policy....they sent out warning letters instead of a prosecution.

With the new system, everyone is summonsed if reported except in exceptional circs.

Simply remembered : The day of the offence is not counted when computing the 14 days. So offence 1.1.04 NOIP should be posted to reach offender not later than the last post on 15.1.04.

Tony - still use the Met caution "Your nicked get in the motah"?

So lets get this right, I went past a scamera van Dec 23rd, I know I was doing 65-70 ish and it was on a 50mph duel carrageway so if its not on the mat when I get home tonight :fingerscrossed: Its home and dry regardless of bank holidays, christmas leave or any other excuses ?

Yes you are home and dry as long as the vehicle is registered in your name.

Mel,

I'm in a similar situation - my date of flashing was the 14th dec, I still haven't had an NIP.

My understanding actually is different to tonyrec's (and I know that Tony is more - ahem - professional about these things, so I disagree with caution ... )

You are not completely home and dry, as NIP's are counted even if they are delayed in the post, lost in the post, not delivered and so on, apparently. Therefore, although it is now coming up to 4 weeks since I was flashed, I am still in trepidation that the local post office have it kicking around in the bottom of a mail bag somewhere.
