"Totting Up" procedure
Discussion
Can anyone shed any light on this for me?
A friend of mine (well, actually an employer I do freelance work for!) was Scamera'd last year. He already had nine points on his licence, so he was written to, and told he would have to go to court.
His court appearance is this week (Wednesday), and presumably he will be found guilty (68 mph through Motorway roadworks with a 50 mph Scamera)
In the time period between the offence, and the court date, six of the points are now out of date (over three years old)
If he gets landed with 3 points in court, does this leave him disqualified or not?
I was under the impression that points were valid from date of conviction, not date of offence?

Unless there has been some change of late then it is calculated from date of commission of the offence back to the date of conviction, which puts your friend liable to disqualification.
This is necessary so one cannot escape a disqualification by having the case adjourned to fit an expiry of points.

I think I remember reading on here a post that said the back of the signs had to be legal. Writing on the back had to be smaller than 25mm if in contrasting colour or 50mm if non-contrasting colour (IIRC). If it falls foul of this then the old limit applies and your employer is doing 68 in a 70 and OK.
IIRC if Highways invoke their power under Section 14 RTA 87 to make temporary Order to cater for road works contravention of the Order (i.e. speed) is an offence under Section 16 which under Road Traffic Offenders Act 88 attracts 3 -6 points etc.
Without research if they put a minimum speed limit in Order, as far as I am aware that doesn't attract points.
