first of all hello to everyone!
I have recently been caught doing 38mph in a 30mph limit, I was notified in the usual way thru the post,On the original form it stated that I could see the photographic evidence if I chose! I sent the form back to the police requesting to view the evidence and the next letter I received was a letter stating they had decided to give me a fixed penalty of £60 and 3 points on my license.
My question is this: Do i have a right to see the evidence that pertains to the offence I allegedly committed or do I lie down and take this and merrily go on my way.
by the way vehicle was my Transit van, clean licence since 1989,

No, what they WANT to do is give you 3 points and £60.
Get your wife to send back the NIP with your details on, but don' sign it under any circs.
Youv'e told who was driving, but as youv'e not signes it, it can't be used in court. There is no legal requirement to sign it, so they are stuffed.
Do a search on here to find out more, but basically forget it.

Write back to them and point out they made the offer for you to view the evidence and that you wish to do so.
Having viewed it you will know how you stand i.e. do they ID you?
There again if you were speeding have you the balls to admit it.
There are those that will advise the no signing route on which the Authority may, only MAY give up, but if not then start studying:
Road Traffic Regulation Act,
Road Traffic Act 88
Traffic Signs and General Directions
Road Traffic Offenders Act
Police and Criminal Evidence Act
DPP v Broomfield 2002
R v Dwight YORKE 2003
and you may be in a position to fight but this is best left to a Solicitor well versed in Traffic Law, which will cost you well in excess of the 60 notes of the Conditional Offer.
