Details are still sketchy as the police won't give full details.

The police went round to my mother’s house, saying she damaged someone’s plant in there garden.
They want my mother to write a letter of apologize or they will arrest her, at this point my mothers in tears as she did not do it and has never been in trouble before, luckily her friend was with her told the police she is not going anywhere! So they told my mother to go down to the police station tomorrow at 5pm to give a statement.
They told her this took place near the train station but won’t say where, (about a mile from her house)
They didn’t say a day or time, BUT said it happened end of OCTOBER 2009!
Apparently she drove off in her car and the description fits her, BUT won’t say what the description was.
There is no other evidence yet.

My mothers scared as she didn’t do it and doesn’t know what to do, what are her rights?
and what can she do?
I am going with her tomorrow for the statement but don't know what I can do to hell.
All I know it I’m 100% sure it wasn’t my mum.

Sounds a bit sus. On the off chance, make sure someone stays in the house. Why would they say apologise or be arrested THEN come for a statement.

Did the mum or friend get the badge numbers of the Officers or which station they are from?

Call your local station, explain the situation in full and get confirmation of if/who the officers, if they're real then fine just liaise with them for the real story.

BUT this sounds very suspect and could be a confidence trick

Seems an odd visit - too vague. IMO, plod should have dates and times of the alleged offence to make a visit. Has she got any paperwork from plod - with a name / officer number on it? I would call the station long before leaving the house tomorrow just to make sure that these really were plod, and not some impersonator trying to clear her house for 5pm Friday so they can pick up her stuff.

If all stacks up, go down and make a statement on the basis that they can give her the details of what she has been accused. Where, When etc.

She did not do it, then simply state that and if she can (honestly) say where she was at the time of the alleged offence and corroborate that, then it will help. If she cannot remember where she was, do not falsify an alibi, stay honest and let the system prove guilt.

Tell the truth, she will be ok. The onus of proof is on the accuser.

Be very careful,

Sounds like a con to get her out the house at a specific time so they can rob the place if you ask me.

She may have thought they were real coppers but they may not have been.

Call the old bill to check if you can. Failing that leave someone at her house whilst you both go to the station.

I can't believe the old bill have time for what seems like a completely trivial offence

Ask for the policeman in question by name, ask to speak directly to their superior officer and explain the situation. Something here is very wrong!

I'm not sure i'd go and make a statement - especially if they are very sketchy on the information they are giving you

Best advice phone up a legal advice line - lots of people have this free with their motor/home insurance - or post this on a legal forum. I would ask the police to give exactly the information they have in detail - and as per last comment - do not make anything up - if you cant rememeber where you were just make that statement - "i do not recolect where i was that day - but i definately do not recollect the allegations you have made" - keep it simple

sounds very bizarre to demand an appology or threaten arrest - surely damaging a plant would be a civil matter? unless your mum did a hand brake turn running over serveral kittens, school children in the process?

So yeah speak to a supervisor and be told the same!. I doubt very much they have just decided to select your mother at random.

Sounds to me like there's something linking her to it, a chance (if she had done it) to make good has been offered to avoid an arrest. We do a similar thing with low level jobs, try and resolve them without arrest. However that means someone admitting something.

If she didnt do it then let them lock her up, see how far it goes, from what you've said if she didnt do it then she has nothing to worry about.

This is either a troll or a wind up, there is no way on earth that the police would make a house call to arrest someone for breaking a plant pot 4 months previously. If in some strange Universe they did they would require to provide exact details of the location and time of offense. They would also NEVER ask for an apology for an alleged offense. If the police have a suspect for a reported crime they must first caution the suspect prior to any statement being made IN ALL CASES WITHOUT EXCEPTION. Once this is done an acting Sergeant can decide to issue a caution for the offense if the suspect admits guilt.

This is a wind up, call the Station immediately and report this.

I will be calling the station tomorrow morning to find out more info before we go down to them, but the two officers that went to the house were very arrogant, so i hope im not seeing them tomorrow at the station.

Agreed - hey what a great idea - turn up threaten someone to come down the station and make a statement at a certain time - and clear out the house while your out...

Mind you maybe they're working their way backwards through unsolved crimes - i expect someone will ring me up in about 4 months and tell me they know who broke into my car in 1991

I think that it is very unlikely that these two people had anything to do with the force if your description of events at your mother's house is accurate.

If they do turn out to be plod, do not be scared of them if they are at the station. They will behave in accordance with procedure, especially at the station. Your mother should be honest, and be confident in her honesty. Do not be emotional or antagonistic on her behalf.

The police are people just like you - and if you treat them with that respect, all will be well - IME.

Erm, its called 'Local Resolution' where I work. Used quite a lot to good effect. Saves a lot of unnecessary arrests and years ago was termed 'Words of Advice'..
So its procedure in certain Constabularies..

Brush up on my procedures?, how about you stop talking about things you clearly know nothing about. Local resolutions are common practice ta very much.

Saves locking someone up for a poxy damage.

For example:

Report of kids having smashed a window

We arrive, I/P says 'it was him there' and points to a 14 year old kid in the street.

12 months ago he'd be down the cells, now we can deal with it on the street with his parents by getting it resolved by paying for damage and making good.

Saves the kid a trip to the cells, I/P is happy because window gets fixed.

You'd have that bottomed out in 20 minutes, arrest him and you're looking at hours if not days to finalise it.

So I suggest you go and do some reading up on the subject.

No, if she didnt do it then there's no evidence is there?. Let them carry on if they want to waste time with following it up.

My bets is it wouldnt even get past the custody sgt to authorise detention.
