I was in Court today waiting for my case to be called up. During this wait, two Traffic cases were dealt with.

1) Young lad stopped driving with No Licence and No Insurance.

2) Middle aged chap caught doing 98mph on the Motorway.

What do you think the sentance was for both?

1, £100 fine year ban

2, £300 fine year ban

1) £10 fine, waived because he aint got no income, no points, no ban

2) 3 points, £200 fine, threat of jail if not paid immediately.

I cant keep everyone in suspense but here goes,

The man with No Licence or Insurance = £275 incl costs + Disqualification for 56 days

The chap who was Speeding at 28mph over the limit = £325 inc costs and 5 points

Very very strange to me !

How ridiculous.

So he's banned again despite having no licence = no effect

His fine is tiny and it's less than he's saved on insurance

Exactly!

I know that its my job to stop people who are speeding but............it does make me mad when you see the comparisons.

How come 98mph ended up in court? My mother was caught doing 98.5mph on a motorway and got 3 points + £60 fine.

Maybe Trafpol officers could voice their opinions about this sort of thing, after all they are the trained experts dealing with the motoring offences day to day and therefore must have a better clue on appropriate sentancing.

I dont know how he ended up in Court. Most probably the Trafpol didnt give him the option of an FPN(E) and stuffed him in the book instead.

In reality though, youre not going to get a Trafpol voicing his opinion about fines and sentancing, thats purely down to the Courts to decide.

Almost all Police Officers feel that their own job is done when a person gets to Court, whatever happens inside the Court is out of our hands and if the Courts are misplaced then theres not a lot we can do about it.....sadly

I have given people an FPNE for doing over 100mph..thats down to my discretion and obviously how the people react and obviously the circumstances (weather/amount of Traffic etc).

I have however, known certain CJU's revert the ticket to process because the speed involved is over the ACPO guidelines.
If this ever happened to one of my cases that ive dealt with in what i feel was an appropriate manner then i would have the serious arse.

I got a FPN for 97 a few years back

The injustice of the penalties dished out to uninsured/unqualified drivers is something that needs highlighting.

There was a piece on the radio tonight about an illegal immigrant who ran over a 9 year old in Worthing I think, and buggered off. Can't remember all the details but IIRC he was done for driving without a licence, failing to stop, failing to report, no tax or insurance, and having a false passport. He got 2 years. I was incensed.

Best of all is that putting him in choky for 2 years gives him what he wanted - at least 2 years in the UK!!
