Sorry if this should be in Speedplodlaw, move if you want.

Quick run-down..

Me and a bus arrive at the same corner at the same time from different directions.I stop but before i get a chance to reverse, bus decides he can get through the gap.

Goodbye to my bumper, wing and steering rack(as well as a bus-green gouge across one of my polished alloys)

Long and short to it is that they admit being at fault but are not willing to pay the hire charge costs.

Now,all i did was to phone my insurance company to report the accident, and ask them if i am supposed to now phone the hire company, from the details that came stapled to my policy.

I wont name them, but when i saw the bill for less then 2 weeks hire at over £2000,even i thought that was a piss take!

The legal team representing me in court suggest i bring bank statements,as well as wage slips to prove i could not have paid for the hire cost myself!

As far as i am concerned,i have done everything by the book and should not have to prove anything>

Can anyone advise me if i can stand up and tell them where they can insert their request for proof,or will that get me in more trouble then it's worth?

Many thanks
for any help in advance(even the stupid suggestions that might follow)

Why don't you claim on your insurance and let them subrogate against the other insurers.

No. Hells 'Angel's might give you some 'assistance' in guessing.

They are a part of Helphire - its not an usual situation. Normally we see them getting sorted before going to court but some third party's do drag it all the way to the courts - this is obviously to heap pressure on to the Accident Management company - to lower hire costs etc. I remember they use to have a £10 (might be more now) policy that they should have offered you that will cover you in situations like this. You are obliged to go to court to help Angel's lawyers. I have never seen someone having to pay the full costs of the hire. Remember you were not at fault - you deserved a like-for-like car. Any further questions pm - happy to help.

What have your insurers said about all this? I would be pushing any issues back to them.

Cotty,if i knew what that meant, i would probably be representing myself.;)

Chris, thanks for the offer. As far as i remember, i did take out that extra cover.
I think they are suggesting i should of looked for other competitive quotes for the hire, as well as paid myself, then claim back costs in court.

Neil, My insurance company (Rocky Balboa’s wife) informed me that my policy if now high due to me claiming for these damages, until the court hearing.

Once again, thanks for all the help.

Ah ¨hired help¨ Yes. I've had dealings. Lots of solicitors letters that scared me senseless being just 18 and told they'd ¨sort everything¨...only they didn't...

Sorry 20 years in insurance, I tend to assume people know things they probably would not. Basically what it means is you make a claim under your own insurance. Now your insurance company has the loss and they pursue the third parties insurance company for the settlement.

http://en.wikipedia.org/wiki/Subrogation
"Subrogation is the legal technique under common law by which one party, commonly an insurer (your insurance company) of another party (you), steps into your shoes, so as to have the benefit of your rights and remedies against a third party such as a defendant (bus companies insurers).

I added the bits in bold

In short, you are paid out and happy and your insurance company have the problem

It's probbaly too late but if teh accidents not your fault dont go through your own insurance, it only brings another level of grief
Claim direct from the third party and if you cant handle it use someone reputable and independent like europa

If you just wanted to hire a car then you would, should have gone to a proper car hire company. I thought it was well known that at least some of the companies calling themselves "accident management" companies are hire car scammers.
If you had fully comp insurance then your insurance company could have handled the claim for you so I assume you had TPFT. It sounds strange though that your insurance company would recommend that you use a company that rips off insurance companies.

Thanks cotty, there was supposed to be a smilie after my comment to you.

Sabby, yes it is too late, and i am not talking about helphire (couldbetheotheronethough)

Herewego,(irony?) my insurance company sent me to said garage for the repair, where i also took the hire car from.
My insurance company stapled a hire car leaflet to my insurance policy, that they then told me to contact when i reported the accident to them.
Yes i now know they are no better than Dick Turpin with their practices.
I have fully comp.
Insurance company acting strange? Well i never!

The way i see it, I have paid for an insurance policy, used it according to the law and apparent benefits that come with the policy. Am i wrong in thinking this?

Always work through your insurer when it comes to additional costs such as hiring a replacement vehicle. That's why you pay the premium. To do otherwise invites a challenge over incurred costs, especially if they are higher than usually expected - Streaky

I can only think that you'd be responsible if you had insisted on some fancy replacement car that you didn't need but since your insurance company arranged it all that can't be the case. I don't understand why they'd want you show that you couldn't afford to pay. Either you're liable or you're not, it surely isn't a matter of who can afford it.
