I don't want to say too much on the matter, but basically...

Some months ago I was involved in a slow speed incident in a car park whilst parking, I think it was the other drivers fault, whilst they claim I am to blame. Now, i have recieved a solicitors letter saying they are going to claim for losses and basically I want to know...

Am I best of letting my insurance company dispute it, which means they wil pay out if they think they will lose in court. Or am I best off simply "notifying" them of the matter, meaning they do not take it any further and then I am liable for the costs, if of course, i lost in a court.

I estimate the losses would be about £250 and then you add on 10% costs for a small claims court action if i'm right? The reason I ask is that i am worried if i let my insurance company argue it they may find it easier to just pay out, which means I have a claim on my insurance?

In many cases where there are no independent witnesses the insurance company settle 'knock for knock', therefore you will get an accident record. Did you inform your insurance company at the time? I would think that there is no way you will get the other driver to accept liability, so you will need to inform your insurance company and they should follow it up. Tell them you are definitely not accepting the blame as it was not your fault, they should settle knock for knock. You could offer to pay for your own damage and mat keep your premiums lower that way, but if the other driver is insisting on attemting to claim from you I really advise you that your insurance company needs to know.

The Insurance company does know, i informed them. I just need to decide whether to let them argue it, or if I should argue it myself. If I do it myself i have the risk of court costs, if they do it i could have a claim against my name. There was no damage to my car so i am not claiming for anything.
