A drink driving conviction more than 5 years ago.
Should this be disclosed, or as its over 5 years old (and no longer on the driving licence) does it not count?
Cheers

Well, it is certainly a criminal conviction.

Whether you have to disclose it depends on how old you were, what sentence was imposed and what sort of a job you are applying for.

If you were over 18 at time of the conviction and you were fined and disqualified, then the relevant disclosure period is 5 years from conviction.

Be warned that certain jobs are exempt from the Rehabilitation of Offenders Act and the conviction will remain disclosable.

Teachers, doctors, lawyers, the armed forces to name a few.

Drink driving stays on your licence for 11 years and yes it does count.

What about a caution? Do they count?

A caution isn't a conviction.

But its not on the licence any more, and when trying for insurance, etc, it always says "....within the last 5 years" ?

Dont be so stupid.

Rehab. Act - 5years to disclose unless specified by an exempt employer (school, hospital, docs, military, police etc)

The DR charge should still be on your licence for 10years though i believe, simply that you dont need to disclose to insurance etc after 5years have elapsed.

For these purposes a caution is a conviction I thought, just a courtless conviction?

Put it this way if it is an issue and they find out about it the company is likely to find a way to get shot. If it is mentioned on the form they already know and can decide if it makes a difference. So while telling them may mean you don't get the job lying or failing to mention it could loose you the job later on.

If the job involves driving a company vehicle, then I'd mention it, just to be safe from them later finding out and them taking the job away.

If it's a non-driving job, then don't.

To quote from The Home Office website ( http://www.homeoffice.gov.uk/police/powers/caution... )
"Will a simple caution go on my criminal record?

A simple caution is not a criminal conviction, but it will be recorded on the police database. It may be used in court as evidence of bad character, or as part of an anti-social behaviour order (ASBO) application."
