Hopefully a quick piece of advice from a follow pistonhead.

I sold a second hand item recently to a guy who approached me. Thus the contract was between him and I

He paid me via paypal

After having had and used the item he was not happy with it, I refused him a refund. He approached paypal and they have now decided to refund him the money, make him send the item back and debit my account with the money.#

They took no evidence other than a couple of emails from him, and refused to take pictures from me to support the condition of the item.

Question. Bearing in mind he has no statutory right to a refund on a second hand item, the fact that the contract for sale was between him and I, the lack of evidence they were prepared to take before sending him a refund.

Can they do this, should or am I obliged to pay them the money back?

What do the paypal T&Cs say? Paypal is a third party in the transaction.... so its not strictly just "you and him"..... it should be though...

I guess thta s part of the question.

There T&C are lengthy to say the least, I did have a look but you can bet its in there somewhere, a get out of jail free card. Was more interested in the fact the contract was made between him and I and the lack of evidence they took before making a decision, they have taken the easy route and ignored what little rights he does not have.

Only link your paypal account to a credit card. Then you can dispute the payment.

Was the item bought via ebay?

No it was not sold on ebay, he approached me directly.

They wont take the money from any cards linked to your account they ask you
to pay into the account to bring it back into credit

guess a good reason not to use paypal unless selling on ebay, with paypal, the buyer is always right...

yes


I have recently, even as a buyer avoided using any service which involves PayPal and will continue to do so until they allow a situation where there is a fair bargain between individuals.

It's "him and me".

"I" is a pronoun that must be the subject of the verb. "Me" is a pronoun that must be the object of the verb.

In examples such as the above, the easy test is to remove the other noun and the conjunction, e.g. "The contract is between him and I". If the sentence then doesn't sound right, it very probably isn't.

Do you go through every post looking for spelling & grammatical errors??? The OP is asking advice relating to a Paypal transaction not his grammar rolleyes
