So, I took the chance, got clamped, then paid the release fee. After googling the clamping company, CP plus it seems they are total shysters. So, my question is, even though I was in the wrong (parked in railway carpark without ticket) can I claim the fee back?
Worth a try.

Ignoring the Civil/Criminal side of things for a moment.

You admit that you parked in a car park without purchasing the required ticket - so you broke the rules and you got caught. Why should you have a right to claim the money back? I'm confused...

Because it appears they may not be authorised to issue fines/clamp cars.

Do they have an SIA number?

fines
Only govt can issue fines, civil companies cannot issue fines. If ANY of the paperwork mention fines, then its illegal.

Even the government can't issue a fine without taking you to court...

CP Plus appears on the SIA's Register of Approved Contractors for vehicle immobilisation.

According to the CP Plus website, "Over 100 CP Plus staff have been licensed by the SIA for Manned Guarding, CCTV Monitoring and Vehicle Immobilisation."

What about Fixed Penalty Notice for parking?

Thats lovely for them, but each and every clamper has to have SIA registration smile

That's a fixed penalty notice, not a fine...

My point (which I really should make clear) is who said that the person who clamped the OP was SIA registered? smile

Why should some private company be able to immobilise someone's car and extort money from them?

Clamping is despicable - show me a clamping firm that isn't run by awful pikey thugs and I'll show my arse in front of the town hall.

Am I the only one who sees the irony in clamping?

"You parked here without paying for a ticket, taking up a space. To remedy this, we will clamp your car, so you cant move it"

Worth a try.
Looks fair to me, the land owner is probably upset with pikeys trying to get out of paying tickets, so they pay more pikeys to clamp people trying it on

You can spend money trying to get a refund, or perhaps learn to buy a ticket next time, what is it £5 per day ?

Yeah, I know you're right... £5 versus £125 for clamp release, easy one really.
Just after reading about them on the net, seems they are cowbiys so wondered what my chances were of getting back the release fee?

The people who moan about this would be the first to complain if they turned up at the station and couldn't park because the car park was full of shoppers' cars and pikey caravans, not to mention weeds and cracked tarmac, because the owner wasn't allowed to prevent anybody who took a fancy from parking there. Cowboy clampers should not be confused with landowners who don't believe they owe the lazy, tight-ass public a living.

As far as this situation goes the only shyster was you!

You might want to try this letter:

Dear Shyster,

I know I am a shyster and tried to get away without paying the parking. However, after using Google I have found that you are shysters too. Can I have my money back please?

Yours sincerely,

Your Shyster brother in arms.

Did you pay in cash or by credit card (not debit card)?

So the OP checked their profile and found lots of other people who went to a car park expecting the car park at the station, hospital, town centre to be free of charge, never carry money in their wallet or change in the car to pay for parking and are then amazed that they get clamped ?
