Guys, girls

I would be gratefull of a huge favour,

The new extremely attractive blonde girl who happens to be now sharing my office is in the process of having her car written of, the insurance co have just called to tell her that the car is \ was already a cat c write of and that the claim is void as she did not inform them of this.

So can anyone help with some info please ?

Can this happen and if so should the insurance company not have already checked this at time of taking out the policy.

Any chance anyone could do a vehicle check for me ?

Extremely gratefull if any one can help \ advise

Ay? Whenever i've taken out a policy they've not once asked me whether the car had any previous damage! Anyone else experienced this?

If she didn't know it was a Cat C then she's in the clear I would have thought.

I have never been asked this. What does the small print say?

I've been asked this on my insurance policies for years now, except for new cars obviously. I guess it is because the insurance firm will then limit the maximum level of payout based on the write off category it has already been subject to, or not want the business on a fully comprehensive basis due to likelihood of claims if the "repair" was not done properly.

If the lady can prove the car was sold to her without any indication of the Cat C condition (original advert, receipt both/either not having mentioned this) she could plead innocence and see if her insurers act favourably in this case.

Otherwise it's bend over and take it time.

IANAL blah blah, but as the information is so freely available I'd have thought she'd have a hard time pleading ignorance.

A 3 quid text would have told her.

Caveat emptor and all...

I am sure someone will comment who works for a insurance sales team ? But the moment they type in the REG i am sure it accesses some form of data base that would have told them .

Time for a "freedom of information " request .

1. Did she get a HPI on the car when she bought?
2. Did she buy it trade or private?
3. If trade then what did the Advert say?
4. Did she insure over the telephone or paper?
5. If over the telephone, ask them for a copy of that conversation under S7 of the DPA.
6. If on paper, did she keep a copy of the form? If not, ask them for a copy of it.

I was under the impression if a car is cat C / D and has been put back on the road that it states this on the log book.
Is this not correct?

would the insurance of been cheaper if it was a cat c then a non crashed car.
