Are you certain you have a Protected Tenancy, or do you simply have either an Assured Tenancy or a Periodic Tenancy? We have lived in a private rented house since feb 96 with a assured tennancy (protected) House went to auction & and we are having problems now

The new owner of the property, will either need your agreement to vacate the property, or following a Notice for you to quit, a Court Order to evict you.

You need to find out exactly what type of tenancy you have. The new landlord may well be able to serve a Section 21 Notice and apply to the court for possession if you don't leave. This will of course take time.

The first one gives the grounds for possession that the landlord can use. Some are up to the courts, some are mandatory but I rather doubt any of the latter will apply in your case.
Many thanks so far our Tenancy is a Assured Periodic Which as i was told by our local council is a protected one,The new owners brought the house @ a auction, We asked the owners of the house if we could buy it & offered a bit more than they got @ auction,But due to subsidance could not get a morgage on the place They sent in the cowboy builders to "put right ish & cover up" Then it went up for auction When i say cowboy i mean cowboy we had 3 bathroom celings as they kept falling down due to no pva being put on,The groundworker wired in the new hob using a 13a plug & wondered why it blew fuses! replaced now,As for the flooding on the driveway they put a drain in then piped it into the sewers/water main were the poop goes
The new owners are trying to get us to sign a new Tennancy Agrement which has changes & a end date
If im going to spend money with a solicitor im wanting a good one who knows his/her stuff
a big thanks so far ....

What I would ask is why would you want to buy a house with a possible subsidence issue and why would you want to remain renting a house that's a deathtrap through poor workmanship? The new owners are trying to get us to sign a new Tennancy Agrement which has changes & a end date

If the new onwers are trying to get you to sign a new tenancy agreement then that's their right as landlords. You will need to check through the full detail of your existing tenancy agreement to determine whether or not the previous owners have entered into an illegal sale or otherwise reneged on the terms. However I fear your only recourse in that event would be to seek financial compensation for your inconvenience and may not have any rights to stay.

You therefore have a Periodic Tenancy, which means that a landlord only needs to serve on you a Section 21 Notice of 2 months to seek possession of the property, following that up if need be with repossession/eviction via the Courts. The new owners are trying to get us to sign a new Tennancy Agrement which has changes & a end date

I have details of a "No Win No Fee" solicitor, if you want details pm me, although if the property is as bad as you say, are you not better advised to seek an alternative home?
The reason for wanting t stay her is my daughter is starting high school in september & its just up the road,Its a nice area & i can park my hummer here and not have any worries about damage from idiots,The off road parking is great the house fit our needs perfect My Daughter is the main reason just turning 11 starting "big" school & i dont want to take her out of her frendship circle,I just dont want to stress her so near to her high school life
Its as bad as i say but has been done up so no flooding now drainage is now sorted & the decorating is done by so in all its great

Sadly this, unless you want to agree to the new owner's terms...JJ
