No MOT - not my car
Discussion
Over a month ago, I got pulled over and given a producer. The car had no MOT although I wasn't aware of this as it wasn't my car. What penalty can I expect? The tax, licence & insurance were all OK.
I was told I may get a court summons for no MOT and failure to produce an MOT document. I've moved house in the mean time since then and haven't heard anything. What happens if they send the summons to the old address and they think i haven't responded? Should I phone them up & or just leave it?

worst case? after no response from you,a warrant for your arrest could be issued. next time you are stopped or came to notice, nicked. but you would probably be bailed almost straight away with a time and date for your local magistrates court, they could bail you to the court covering the offence. you would then have to explain why you left it so long before stating your innocent. Of course if you happen to be out with the in-laws/boss/kids at the time your caught!!!embarassing.
Go along & have chat, always worked for me, be apologetic & polite & explain you were unaware of the cars non mot status. Has it got one now though? if so take it along to show the car is/was safe etc.
No point burying the matter, at the end of the day I'm sure mr plod would rather have a polite chat & resolve it there & then saves paperwork & makes people happy. there less likely to proceed if they know someone realises they made a mistake.
Always worked for me when in iffy circumstances.

CPS charging standards in respect of No MOT are that if the MOT was less than one month out of date, and there are no other offences disclosed, then often an advisory letter will be sent and that is the end of it.
If you are "stuck on" then it is only a fine. You cannot get points.
Best advice - go to the nick where you produced the docs and get a message to the Officer. He/she will be able to tell you whether a file was raised, and what the state of play is. I've never seen a warrant for No MOT only, but it is possible. It would probably be backed for bail, but it's not certain. People have certainly been nicked Saturday lunchtime and spent till Monday in a Police cell on a FTA Warrant for No Insurance.
