Youtube and the law

If you're as much of a car nerd as me, you've probably searched for a few of your favourite cars or ones you're potentially going to buy on you tube before.

It is amazing how many UK vids are on there clearly speeding at license loosing speeds.

I remember seeing in the news ages ago some dude got nicked for putting up a video of him doing a high speed on the motorway in his new Ferrari. I think that he showed the speedo though and that was what was incriminating.

Even though the speedo can't be seen you can tell from the revs and the gears what kind of speed they are going...

I'd assume the plod do look at these kinds of things are these uploaders leaving themselves open for prosecution?

I was just watching a vid today of an Audi r8 driver driving like a maniac in belgrave square and during the day too. There has to be at least 20 embassies there and with all those embassies, I would imagine there would be police cars but no.

I dont think the video by its self can be used to charge you, however it can be used in conjunction with other evidance (eye witness accounts, cctv, forum boasting ect).

In the other link didnt the guy drive past an off duty copper who reported him, and when they spoke to him about it he admited it was him?

Interesting.

I don't think there is anything wrong with a spirited drive, but you have to use your nod. Empty country roads where you have line of site for a stretch, you can open the taps, blind corners, take it easy. But traffic and pedestrains around, it really winds me up seeing people drive fast or doing stupidly risky maneuvers on congested roads/motorways.

Why you would film it and upload it to the internet is beyond me.

Absolute tool. I work near here, you cannot drive like that in a city, its obnoxiously dangerous, London is not a good place for speeding there are far too many uncontrollable factors, especially during the day.

On traffic cops the other week a traffic officer saw a video on the web.He recognized the area and went out and filmed between a sign and lamppost in the clip and then worked out the speed of the car in the video.They then traced the driver and prosecuted him.

Yes lots of awful driving and the Audi R8 with the tubi exhaust is in most of his videos which suggested to me that the belgrave mad driver is the same guy. yesterday in old brompton road, I saw that same R8 with an Aston Martin vantage racing. Yeah it was 9:45 pm but that doesn't mean the road is an open track day.

If you wait 2 weeks before posting it does it mean you are unable to be prosecuted for speeding?

Sec 1 of the Road Traffic Offenders Act 1988, states that before certain offences can be prosecuted:

- the defendant must have been warned of the possibility of that prosecution at the time of the offence,
- the defendant must have been served with a summons (or charged) within 14 days of the offence,
- a notice setting out the possibility of that prosecution must have been sent to the driver or registered keeper of the vehicle within 14 days of the offence.

The offences which require an NIP are listed in Sch 1 of the Road Traffic Offenders Act 1988 and include:

- Dangerous, careless and inconsiderate driving
- Dangerous, careless and inconsiderate cycling
- Failing to comply with traffic signs and directions
- Leaving a vehicle in a dangerous position
- Speed offences under ss.16 and 17 of the Road Traffic Regulation Act 1984

The requirement to serve an NIP does not apply in relation to an offence if:

- at the time
- or immediately afterwards
- owing to the presence of the vehicle concerned
- on a road
- an accident occured

Each of these features must be present to remove the need for an NIP to be served or a warning given.

Surely Any decent lawyer should get you off a youtube speeding charge due to the integrity of th evidence. frame rates etc can easily be increased. which would appear you are going a lot faster.

My office is in Knightsbridge, I see loads of this.

Its 'mostly' Arabs that do that kind of stuff and lets face it, there is only a handful of people in the world that can afford Veyrons etc.
