My wife received a 'parking charge notice' through the post today. It says "Your vehicle was recorded parked on our Client's Private Property at MOTO Exeter from 12.15pm to 04.08pm on 10/10/2010 and remained on site for 3 hours 53 minutes. Having checked your vehicle details with the DVLA, you were the registered keeper at the time of parking. In accordance with the terms and conditions clearly and prominently displayed and agreed to when your vehicle parked on our clients private property the payment of £80.00 is required within 28 days from the date of this notice. We will accept the reduced sum of £50.00 if the payment is received before the 27/10/2010. If payment is not received within 28 days, an additional administration charge will be incurred. We are holding photographic evidence on file to support this claim."

The details are correct, her car was parked there at that time - it's the services at Exeter. Is this one of those things we just bin and forget about, or do we stump up the fifty quid?

there was something on this type of parking fine on BBC watchdog earlier this week. might be worth iPlayering to see if there's any ways to deal with it.

I've had several of these.

Well documented speculative money making scam.

Ignore all letters and they will fade away.

Trust me and a thousand others, do not fold up and pay.

I suppose it's due to the services stating 2 hours maximum stay. Can the likes of Tesco enforce this?

This issue has had so much coverage - check out speed, plod and the law.

The golden rule seems to be don't reply ever, as a registered keeper has no obligation under any law to tell a private company who was driving at any particular time. I think the thread is "Streaky's letter"

Shame you've posted on the net she was driving.

Honest John has a second solution which is to send a sum of £5 in full and final payment, and leave it up to the company to prove that their contract with you requires further payment.

But this of course breaks the PH rule above.

Dont reply even if they roll out the increase per day charges , possible wheel clamp , court case blah blah blah b@llocks they will go away

Why was she in a service station for near 4 hours?! Surely they've got staff parking? Or separate hotel parking?

Or was she ignoring the MASSIVE signs that say "2 Hours MAX" on them and using it to get picked up from for a trip somewhere else..? She broke the rules, why doesn't she pay up?!

People who make idle 'fines' without clear signage are scammers, people who ignore adequte signage and park anyway are either thick as st or (in their own little way) doing a bit of scamming themselves. Which one is she..?

Anyhoo, I'll get my flameproof; since the isn't what you want to hear, I'd imagine you'll get a little hissy in a sec...

Do some research on the subject and you will find these companies have no legal right to your money. They are basically saying "you spent too long in a car park so please give us a disproportionate amount of money as punishment". They can and will kick up an enormous fuss, but they are toothless. They will never go to court because they risk losing the case and all the future payments made by people terrified of the letters they send out. Their business model seems to work on a certain number of no payments and they are happy with that. And why wouldn't they be? Easy money.

She wasn't in the services for four hours, it was a convenient meeting point for my lad's football team to meet up before travelling to an away game. There were spaces in other cars so rather than having a 15 car convey to the game some people shared a lift with others, and because a lot of the boys don't live near each other it isn't always convenient to share lifts from home.

And just for a bit of info, she's neither thick as st nor a scammer, just someone who's car was parked in a large, mostly empty car park that doesn't charge for short term parking. Oh, apologies for not getting into a hissy fit, so you can put your flameproof suit back in the cupboard if you like.

OP, is there a Travelodge (other budget motels are available) at the services?

IMHO you have not been given a "Penalty Charge Notice", its a "parking charge notice". Basically it is an invoice, does it have the statement at the bottom quoting the specific law under which it has been issued? I'll bet it hasn't. Try the MSE website. smile
