I'm just trying to clarify something for a friend of a friend. She's been done by scamera's twice in her first 2 years
and has just had her licence revoked.
As far as I can gather she just needs to book another theory/driving test, pass and she's back on the road. (Assuming she doesn't lose her job, and therefore her company car)
If we ignore her having to pull a sicky until she's passed, not telling her company (and therefore the company car insurers
) that she's had a ban, is this correct or is there another hoop she has to jump through???

:heavyheart:I know. Personally I think she's stuffed, if she doesn't tell her company she's got no insurance and if she does she's got no job. Quite how this helps the causes of road safety or society as a whole I don't know
Both "offences" (I know it's against the law, but you can't help but feel that some advanced training is a punishment a tad more fitting) happened near Taunton.

You will be aware that for 2 years from date of passing test a New driver is on a probationary period and if during that time they accrue 6 or more points then the Driving Licence is revoked. A fine point in that there is no Disqualification. (Road Traffic (New Drivers) Act 1995)
Basically what happens is that they become a Learner Driver again so once the Licence is revoked they have to re-apply to DVLA for a Prov Licence using Form D1 with relevant ID, Photo and a whacking 38 quid for the prov Licence and back at the wheel until test passed. When this has been accomplished they regain all the groups that they had originally.
Now the Insurance bit. They have not been Disqualified by a Court merely the Licence revoked. Not to be covered by Insurance if you look at the Certificate it will state that Insurance only covers " a person who holds or has held a Licence (which they have) and is not Disqualified from driving"(which they are not) - so Insurance will be OK. As to notification of Licence revocation to Insurance Company will depend on the small print on the Policy. Virtually all seem to require that speeding infringement have to be notified so it may well be prudent to do so.

She will have to declare the ban - and will have to do so for at least 5 years assuming it is like the points declaration thing.
Agree - the law is an ass. This obsession with persecuting the driver for slight blips, punishment without remedy is beyond a joke.
Did hear that the Speed Course in Lancs is not offered to provisional licences (understandable to a point as they would be getting lessons) and new probationary drivers either

Dwight, cheers, that's interesting. So assuming (again for the sake of argument) she can pull a sicky
til she gets her provisional licence (And how long will that take
) and passes her test then she hasn't been "banned" as such so could get away with telling her co about the six points. Wildcat - the system sucks, all it will do is push those with a greater need to keep their jobs etc (i.e. mouths to feed other than their own) into the uninsured/registered criminal underclass.
Lucky the new ID cards will prevent that eh?

Presumably the Co should be aware of the speeding offences as being Reg Keeper the NOIP would go to them first?

How long does it take to arrange a driving test appointment nowadays ? I suspect that will be quite a few weeks, and if she's thinking of pulling a sickie for that length of time then I don't think I'd want to continue to employ her !
She's best off telling her boss and HR exactly what happened. If they think she's worth keeping they'll probably give her a dull desk job until she's re-passed. That's what happened in the past to a couple of friends of mine who got banned under totting up rules.

Has happened back "home" UK ones would be very very very lucrative - that is why you should keep tightest hold of passport when abroad!
Agree with you about the system creating illegal underclass! The constant "nit-picking" could turn best of us into a right crim! OTT behaviour and deliberately flouting the law is one thing. Banning an otherwise safe driver for two or four minor blips is another!
Unusually New Driver legislation applies to someone first passing a test. Apply and pass second test, and it no longer applies. I wonder though, licence is revoked, not a ban, so second licence will still have endorsements on it for further totting up. Not quite double jeopardy, as they haven't ever copunted towards a ban before, Sec of State has revoked the licence, not banned her - hence ability to take quick re-test and be back on the roads the following day.
