3 points, £60.

It's a dual carridgeway (Two lanes, but parking allowed on weekend) and the Scamera was parked in the inside lane. I had a car at the side of me so speeded up so he could pull out. Next time i'll ram him into the van Eh?

Even less respect for the speed limits. Getting a scanner now and will start activly getting involved with any speed rubbish (You may have noticed!).

Email is on it's way to my MP.

Take it to court, let the papers know, thats one place where to speed up was THE SAFEST thing to do.

Sent a letter to my MP.

It's cheaper to take the fine

you have nothing to lose by writing a letter and sending it back with the NIP - just a straightforward...this was the situation, and what I did, and see what happens. There are resonable human beings in the world still and they may just can it as a result (obviously in very optimistic mood today)

I would like to know the what the police officers on this forum think of the offence. I would also like to know my legal standpoint.

I personally think that police disgrestion would have come into play with this one.

Cheers

You can't rely on discretion as you either have to complete the NIP, virtually admitting the offence or go to court and risk a heavier penalty being imposed.

Without going to court, they simply won't enter into discussion with you so, as I did over my case, it was easier to take the rap.

I didn't know if I was driving my car at the time, as I'm normally in the office at that time of day, or if my son had borrowed my car (as he sometimes does) but still had to either take it on the hoof or risk going to court.

In the end, I just took the fine and points but still not convinced it was me.

I keep a log now of whoever and whenever someone borrows the car.

Sorry, not quite relevant perhaps to 41 in 40, as mine was 75 in a 60.

The answer in court is you should have braked out of the other persons way rather than accellerated.
