a couple months back one of my mates did something pretty stupid when he was drunk. basically he had an argument with a mate and then punched a window in pure fustration. the police arrived and he admitted full responsibility etc and then went to hospital.

the guy who's shop it was decided not to press charges but wanted paying so my friend offered to pay £20 per month until it's payed off as he's a skint student. the guy didn't accept this and is now taking my friend to court.

the thing is the bill my friend got sent included fitting a double glazed window (the original was a normal window) plus VAT on top & £100 + VAT for the shop owners time to clear up the glass.

in total the bill amounted to about £500 when in reality it should be nowhere near this.

when it goes to court my mate has been told he'll get a CCJ as he doesn't have £500. do you think he will?

can anyone offer any advice as I don't think it's right that the shop owner replaced the window with a double glazed window and is charging my friend for his time.

any advice would be much appreciated.

Just a thought

Why not write to the shopowner saying that your friend has already accepted responsibility for fixing the single glazed window but that he notices that the shopkeeper has upgraded the window to a double glazed unit and also has now added on extra items to his claim, blowing it out of all proportion.

Write confirming that he will honour his original offer of £x per week/month up to a maximum say £250 in full & final settlement and pass on a copy to the court to show that he has already accepted responsibility, apologised and made a fair attempt at recompense.

That or pay up and then smash the window again (without being seen) when next in the area!

Having sat for a day in a mag's court and watched people who were fined told to pay 5 pounds per week - isn't this what a court would tell him to do anyway?!
