Insurance, how do you think this will play out?

Just had someone reverse into the Spyder, scenario was

I'm about to reverse out of parking space in supermarket car park
I let car pass behind who the pulls into space opposite, and stops
I start reversing back, when about 3/4s of the way out of the space the aforementioned car starts reversing out
I see this, immediately stop and sound my horn but car continues reversing and hits rear quarter of the bumper splitting it.

Now my concern is that the insurers may try and go 50:50 on this, though I have witnesses that I had stopped

If it makes any difference other car was on hire from Avis

Eh. He was stationery, what difference would it have made if he was pointing forwards?

ETA: OP - depends if you have any witnesses to say you were stopped, will be difficult otherwise if the other person says you were moving.

Fortunately have 2 witnesses, told me they were 'admiring' the car so were playing pretty close attention when it happened

As long as you have witnesses to say that you were stationary and sounded your horn, you should be ok.

You'll still take a hit at renewal though.

If it was a hire car you should be OK, they aren't going to be especially bothered since they'll get the money off of the renter.

SWMBO finds it easier to load the boot with shopping if she drives in forwards ... most people obviously feel the same way.

I find it difficult to unload my FiL's wheelchair if I reverse into a parking space.

Had this last year with loads of photos showing that the other driver could not see ,when he reversed, past the Sprinter van parked alongside his Previa,but no witnesses it ended 50:50 right PIA as it was my second car that i was only acruing its second year of NCD on.

BTW its only "reversing" not "reversing back" .Pedant mode off.

you have independent witnesses, my money would be on them taking full liability..

Onus is on person reversing as per H/code - in this case I would say 50/50 - been doing insurance far too long......

Wouldn't it have been just as easy to pull forward if you had time to react by sounding your horn?

I can't be bothered answering the insurance piece, as witnesses may or may not provide the evidence you need.

Would you also reverse into a space if there was no access to the rear of the car and you were shopping?
