97 in 70?

Got pulled by police bike for all aledgedly doing 97 in a 70 (at 590m) police man kindly showed me speed gun showing 97 and said that he would give me 3 points and a £60 fine.

From memory I pulled out on the A road in question to move out the way of a caravan pulling out of a rest lane, if I hit the speed aledged it must have been briefly, to be faiir not sure I was anywhere near.

Do I have any options or just be thankful for 3 points?

Nearly 600 metres is a hell of a distance to accurately track your speed and know for sure that it was you.

Aren't there 'vehicle recognition' police guidelines whereby they should be close enough to be able to visually identify the make of car/bike etc they are tracking to ensure no ambiguity - under 400 metres?

Argue with him in Court and say you were only doing 80mph, that way you'll get 3 points and a £200 fine on an SP40, which is much better than the 3 points and £60 fine on an SP40 that you've currently got.

If it was handheld then it's hard to imagine it could be held still enough to be accurate at that distance - I thought the tripod mounted ones could in theory be used up to 1Km but in practice where generally used at much shorter range.

in the USA they limit the distance over which these can be used but that's because there is so much opportunity for beam spread/scatter and mis-aim to lead to incorrect allegations.

These LIDAR guns are known as 'dodgyscopes' in some circles because there are so many ways they can fk up your life un-fairly. GRRRRR

Having said all that the establishment cannot ever admit to the technical issues (imagine the reprecussions to the legal system and loss of revenues to the 'speedawareness' quangos)) so the 3pts is the best you can hope for.

97 is beyond where they normally pursue via FPN (96 max I believe is the end of FPN in a 70) so the officer is being quite generous within the context of a totally corrupted road safety 'system'....

I think you have got away lightly - not worth arguing, as said, albeit slightly sarcastically, above. I would have expected six points at that speed, or even a short ban

I agree, I'd be happy to take that as a punishment, as long as it was you. Also, I thought bans were inky used at 100mph +?

I could be out of date, but I thought they summonsed you to appear in court if it was over 96. A round 100 is an urban myth. Also, I think it very much depends on the conditions and the location.

Yes I believe 95/96+ is entering ban territory.

The last tie I was cought I was told 96 was a court appearance with a view to a ban. Amazing how passing the attitude test and not getting all cocky meant I got 3 points instead.

As I said above 3 points is a result, it's not like the OP wasn't speeding (he as good as admits it), so he's got away with the minimum punishment having been caught.

I'd treat that as a result.

Why not just be thankful for all the times you have got away with it.

I got caught doin 97mph by a camera van on the A74m coming back home from Scotland, NIP arrived and was sent back, I was amazed and so relieved be given only 3 points and a £60 fine.

So if I was you op, I'd consider myself very lucky.

at least he's only citing you for 97 and offering an FPN rather than referring it for court and likely either a short ban or a bigger fine and more points...

I got caught doing 97.8 mph on the M6 near Penrith,ended up with a court summons, £350 fine and 5 points. Id say 3 points is getting away very lightly imo.

I'd just take the FPN & the 3 points-unless you can prove beyond all reasonable doubt in a court that either you were not doing that speed or the police officer's radar device was inaccurate.

The police don't make the law, they just enforce it-so once you've been 'caught' you're advised to enter 'damage limitation mode'.

At least you'll keep your licence & won't have to go to court-the police officer exercised his discretion & you've had a warning shot across the bows, rather than a torpedo slammed into your midships smile

I got caught doing 70 in a 60 zone several years ago by an unmarked van over the Welsh moors. I could have kicked myself-I was following a slowish vehicle & when an empty straight section of road appeared, I overtook & temporarily exceeded the 60mph limit to get past quickly.

Did't even realise there was a speed trap there-just an innocuous unmarked white van in a long lay-by & nothing else around for miles as it was deserted moorland. 2 days later the FPN arrived & I was mortified. I couldn't disprove it or argue mitigating circumstances so I took the 3 points & £60 fine.

My licence has been clean for several years again now & I'm much more careful where to let the car have it's 'moments' & clear out the cylinders smile

It summons territory, but the bench might consider a ban depends on circs. In the ones the OP has put, I suspect a largish fine and 6 points.

Take the FP. Ignore fools and charlatans who tell you to argue it in court. I *guarantee* you the outcome will be worse for you.
