Using popular music in a video legally

I'm after making a short film for uploading to the internet that will be used to promote me, a burlesque dancer and a Hot Rod garage. It will be free to watch. I want to do it right so have been looking into copyright. What gives? I've just being trying to read up on this and the record companies/publishers/rights agencies seem to have made it as difficult as possible to legally get permission to use anything. Why would they not have a simple service in place to let you buy a licence for a track, they could make a fourtune. Yet seemingly if you do use anything without permission they have taken the time to develop software that will hunt you down and ask you to remove it. This is all arse about face. Anyone got any tips or had any sucess with this? I know I could use copyright free music but I've always thought this cheapens a video.
Have you considered MCPS? There will be a usage fee but a fraction of a commercial track.

In my day it was all CDs - publishing companies sent out hundreds for free hoping we'd use them. There must be some kind of online search for retro 50s/rockabilly/'style of' music.

Cheers Simpo, I think alot of stuff I was reading was aimed at the Yanks. Some were suggesting I would have to track down the label myself and deal with the record company. I have emailed PRS to see what there take is.
The track I wanted to use is Shakin' All Over by Johnny and the Pirates. I was going to actually show the record loading as part of the video so need something available on 7" and period correct. This track was owned my HMV, who were taken over by EMI who were bought out by Citibank and the rights have recently been sold to Sony.

I think the issue is "commercial use", I'm not sure where the line is drawn but I want the video to promote something, not directly but it is implied. It's Vimeo that I would use to upload it and thier T&Cs say you must have permission from the 3rd party for any music you don't own.
My research has shown that alot of people break these rules. As we all know copyright laws don't seem to be able to keep up with the digital age and it takes the music busniess 10 years to respond by which time things have moved on.
I may end up using it anyway but wanted to explore to see if I could actually do this legally.

Agree totally with what you say. However strangely enough - when I've used music in the past (which has been created in Imovie and pulling in files from Itunes) when uploaded to Youtube they'll let it run because there's a link provided below the video to the music artist and title automatically. Only once I've done that has it been pulled and replaced with silence.
Does seem mostly stupid though.

Craig, I think you're right and YouTube seem better equipt to deal with this as I believe they have agreements with the major labels. I was put off going down the YouTube route due to the complete lack of moderation of the comments, especially when a near naked woman is involved. But I'll think about it!

I know you don't think much of free music, but why not try some music released under Creative Commons Licences ? Plenty of good stuff out there without too much encumbrance.
I use http://www.jamendo.com/ to find stuff which uses the Attribution version of the licence, which means you can do what you want with it as long as the artist gets a credit somewhere. It's surprising how good some of it is.

...although I could drop that bit. Meanwhile, it might be worth contacting BPI (http://www.bpi.co.uk/ ) as well as PRS/MCPS to discuss licence issues. I know some people in anti-piracy in both outfits if you get really stuck.

Im sure they dont all go to the lengths of contacting the artist or record company so there must be a way round it.
