Is he making money from these conversions? Either directly, as sales or indirectly, as promotional material.
I would be annoyed if parts of recordings that i had made were used by someone else without permission and more so, no accreditation.
If there was financial gain from the other party I would consider legal action, or at least the threat of it. If they were just doing it for their own benefit I would at least expect permission and accreditation.

I used to have loads of my photos nicked... now I generally put words like

'photos copyright Steve Carter and may not be used without permission - usually given'

...and now I get an e mail a week asking for permission... which is usually given (unless they will make money, in which case I ask for a slice).

Im going to say two things, one or both of which is probably silly, and I dont expect anyone to agree with either, but here goes...

1) How did that chap make the image he did? It looks like a watercolour painting, or is the point im missing that he is a very good photoshop guru, and can turn photos into detailed watercolour lookalikes?

2) Now Im not speaking with reference to you BBB, and I hope Im not hijacking either as my comments arent entirely relevant, and this is purely just my own thought relating to my own work, which is:

The one thing that I look forward to, is the possibility of seeing my work in use elsewhere (and I dont give a flying feck if the buyer paid 25c or not for it) ie work which has been paid for - Yes I know that doesnt relate to the fact that your work wasnt purchased! ...

I hope and believe that in time, one day, I will see see my pics on posters, billboards and in magazines and books like others stock shooters have done. Or find them being used by people personally. But if someone did take and modify my work for personal use Id be chuffed to bits.

Still not sure whats going on confused but it looks like he is using your work personally, which is a huge compliment right? Although it must be a bit annoying that a) you didnt get credit and b) the chap wasnt even sure who the original photographer was. Is till good though, right?

In answer to (1); Paintshop has an 'effects' menu, and a 'brush strokes' option. It produces some pretty good results.

They are paintings not modifications of the photos, I don't even know what the copyright situation is in that case. There is a guy round here who paints famous film scenes (bit like the cutout filter) and sells them for £300 a shot, I know he's not the copyright owner of the photos that the paintings come from.

I wouldn't have minded if he'd asked, it just came as a bit of a shock to see them and I don't know what he is using them for.

Personally speaking, if I were in your position I would expect the person making the paintings to have a prominent statement somewhere on his website or even on the physical picture itself something about being created from, or inspired by, a photograph by BBB at the very least. A percentage if he's selling it.

As Steve says, if you ask, you'll get, within reason. If you don't ask...well I'm not sure there's much one can do about that kind of interpretation, but I'd make damn sure as many peopl knew about it as possible.

Sadly these days people take things for granted and assume they can just copy or rip stuff off. I've had 2 of my photos reproduced without asking and I was furious, even though I'm not exactly David Bailey. If they'd asked in the first place, I'd have been ecstatic and more than happy to let them use them, just with a credit.

If he is using the photos for commercial gain, you are definitely within your rights to take any form of legal action, and are entitled to compensation.

I really cant remember the story, or which way around it went. But there was a photo and a painting and a tapestry, or only two of the above I cant remember, and someone interpreted one from the other etc, and ended up using the final product commercially on a very large scale. The liability from the clearly "inspired by" and relatively closely copied design was huuuuge.

You may only have pressed a shutter and captured someone elses moment in time, but it required skill to do, and you as the artist are the creator of that unique and original piece of art. It is yours, in its entirety.

Id be chuffed if he was using it in his home, and angry if he made money from it. Can you find out?

i think once you've changed medium there is no copyright issue sadly.

i'd write to him and ask for an explanation and that he credit everything of yours he's copied, but pretty sure you have no case for recompense.

plagiarism sucks.
