Chip, chip, chip... there's another little bit gone.

Maybe this would be better posted in SP&L?

I think an organised national day is required where everybody with a camera puposely goes out to photograph the police, they simply cannot arrest everybody.

There may have been some rational idea behind the scheme years ago when it was mooted, similar to not being able to take photos in airports for example. This however, has snowballed out of all proportion. The more worrying thing is that this law has passed through parliament (probably buried in a more valid pieve of legislation) and no one had opposed it.

This monsterous, let's assume you are at a PH car meeting for example and take a picture of Tuscan Rat and his TVR does this mean he can now arrest me?

Can anyone point to one reported case where terrorists have used DLSRs to recon an attack? This law is totally unjustified.

If Lee arrested you, it would be serious sense of humour failure time and as such i'd be more worried about his mental health wink

I have, but I've also seen police abusing thier powers given any chance. If they were all like her then I guess we'd have nothing to worry about. As we've discussed here before Security Guards and Community Police are by far the worst offenders for misunderstanding new laws and thinking it gives them god like powers.

Ah well, some person on an internet forum says they wouldn't misuse this so it's ok . . . meanwhile back in the real world . . . how many on here have personal experience of the BiB 'making it up as they go along' or being dishonest . . . I do, multiple times, and I have to say my exposure to the police has been extremely minimal, which in itself is very concerning given what I have just written . . . do I therefore fully expect this to me misused to the personal agenda of one of the increasing number of completely inept fools wandering around the country in uniforms with a god complex (and that certainly includes but is not limited to the BiB) ? . . . absolutely . . .

The act states:

"A person who is able to prove that he had a reasonable excuse for his actions is able to rely on that as a defence."

So if we accept that we aren't going to end up with a criminal record, we are effectively in the same boat as we were before, officers with decent knowledge of the law will leave you alone, those without knowledge of the law will give you grief.

Why should you have to prove innocence though?

So much for inoccent until proven guilty then!
Does the act give any guidance of what reasonable excuses would be, or is that for the court to interperet?

I remember when there used to be this thing called Civil Rights in this country. Better shut up now, you never know who is listening.

So, what about the 100's of thousands cctv cameras scattered around the country. They'll be taking pictures.

Sorry, my comment wasn't that we should have to prove innocence - I definitely don't agree that the burden of proof should be on the photographer.

I was just trying to point out that prior to this new Law, we were already in the position of having to prove our innocence when an overzealous PC or PCSO approached and challenged us. So more of the same really, sadly.

That's pretty much how I've read it, but I'd also add that if you behave like a tt if an officer does question you then I'd lay money on the fact that the officer will treat you as a tt.

Coppers - they're just doing their job.

Regardless of the letter of the law (and I'm drifting slightly O/T by including all pedophilia and terrorist paranoia)...

...IMHO the damage has already been done. How many of us now think twice before taking out a camera in an urban environment? How many of us feel conscious of what those around us may be thinking? I know I do. Not so long ago it would never have even occurred to me to be fearful of retribution for pressing a button on a little box held to my eye... I'd have just carried on enjoying my pastime. Still do, but the enjoyment in some scenarios is affected.

It doesn't seem to matter what the relevant laws actually state - 3rd party public's paranoia and ill-informed, power-crazed uniforms (of all kinds) have their interpretations and/or incorrect beliefs... the letter of the law is not going to heal that problem now frown

You watch any of the "fly on the wall" plod programmes like Road Wars, Street Wars etc, when the crim starts going off on one telling them to get the f****in camera off his face.

The constant reply by plod is "he's in a public place, he's got every right to film here"......

The government is a disgrace.

The terrorism thing is a complete facade. We didn't need this erosion of liberty to deal with the Irish terrorists, and we don't need it for Islamic terrorists either. In fact, we are handing them victory on a plate frown

The legislation was bought in place in NI to tackle the issue. So actually we did have it then. It's also as explained aimed at personal information. It is not photographs alone. Amazing what a headline can do isn't it.

It could have read. New law to stop terrorists spying on our troops to plan their kidnap.

It is not an anti-photographers law at all.

If it gets misused it will be by the same individuals who could misuse any legislation.
