I had a crash..
Discussion
I had a small bump the other night. Nothing serious and no-one was hurt, but it was my first crash and I thought I'd share the pictures and maps I printed off for my insurance company.
I was driving through Newton Mearns, in a 30 zone the other night. It was dark and wet, and as I passed a junction, a Land Rover lurched forward and t-boned me. D0h!
She was stopped in the middle of the road in a hatched area, turning right, and was waiting on me to pass (or so I thought), before joining my lane. In the picture below, I was driving in the direction of the red arrow and she was sat in the hatched area at point A. She t-boned me at the red dot after she lurched forward for whatever reason.

Whilst we exchanged details, she wasn't admitting liability. I realise she was probably just following what she had been told - never admit liability at the scene, etc. Things were pretty curt and formal, and she muttered about me swerving into her. I can appreciate not admitting liability in a humble/legalese way, but to actively suggest that peeved me. I just said we'd just best put our versions to our insurance companies and let them sort it out. There were no witnesses btw, other than my one passenger.
My car is drivable, but the door and a few other panels are knackered.

I see this as a pretty open-and-shut case, but it's in the back of my mind that she might tell her insurers something completely different and it comes down to a "her word against mine" and goes 50/50. The damage pics back up what happened, thankfully.
Anyway, my insurers are great and given me a Golf GTi replacement (great fun!), and all going well, will be sorted quickly and hassle free.
Haha, I just thought, I should have expected something when driving along that road - the big red arrow, red dot and "A" on the road should have led me to anticipate some indicent!

should be fine paul
you have a witness and she doesnt, so in a case like this she would have to establish that it was your fault and you drove into her!!!
Sounds like she s being pretty dishonest and silly and you should have called the police and asked that she was charged! The police are unlikely to be interested now, but in my view you should go down and make a formal complain with your witness and ask that she is charged with careless driving!

I'll be so angry if this goes 50/50! I don't see how it possibly can, given the damage to my car. No matter how (if) she changes or embelishes some little details, the evidence is pretty conclusive.
Sadly, my experience with these types of things is that people will just lie. Both insurers will take the line that most likely to lead to them not paying out. In this case, it sounds like both insurers will be told that it wasn't the insured's fault. Could go 50/50, but for your sake I hope it doesn't. A few years ago I was rear ended in Livingston on Christmas Eve in my Merc - the guy just drove into the back of me. Guy said sorry etc, I said no worries, it's just a small bump don't let it ruin your Christmas, probably just a couple of hundred quid's worth of damage. By New Year his story had changed and he didn't want to fork out for the repair, and eventually my company got it fixed themselves for $140 (sorry, no pound sign on keyboard) because it was less hassle than actually putting it through the insurance. I also got hit on the Lizzie Bryce roundabout 10 years ago in a Discovery. Exchanged details, but the next day the guy claimed I had admitted liability at the scene! Turns out he was uninsured
. Company took him to court and relieved him of Six grand

If she has hit you on your side of the road, I cant see how it would be judged 50/50. Did you get pics at the scene?
Yes, I did. I'm sure I'll be fine.. just going through all the "what ifs", etc. I'll absolutely not settle for anything other than her being 100% at fault though, and cross that legal bridge if/when I come to it.

If you have a witness, as Paul says you should be good to go Paul. No worries, witnesses can always crop up later too......Just noted you got pics at scene, something my mum didnt do which of course let the case down further.
You'll be fine Paul, get her to admit 100% liability and then call accident exchange for an equivalent or better car!!

Sadly have to agree with northo, my sister had the exact same type of accident-her porsche was 't' boned while she was 70% through a junction which she had the right of way, the other 'lady' stated that my sister was going too fast-the police were involved but still the case drew on for a year-why -because the 'lady' had friends in high places. Dont trust anyone...

Good news.. I received a letter from my insurers today that stated "This claim has now been closed and we can confirm it will not affect your no claims bonus".
I've still to phone them to get details - but to me that says the other party has admitted blame or been found to be at fault. That's a weight off my mind! My insurers have been great too. Almost all communication has been via email, which is very handy, and I've not yet had to fill out a single form. They speedily picked up my damaged car and promptly delivered the Gti.
It's good to see them earning the silly amount they charge me for insurance!
