My friend has just received a letter of execution from 'collect services' saying that she owes £247.91 saying they act for Reading borough council and are baliffs. Letter states we act for reading borough council BLE in respect of the following penalty charge notice.

Vehicle reg : **

Description and location of contravention station approach (West to east) : Hyundai (car make but no model, colour info etc etc...)

As the sum due has not been paid a warrant of execution has been issued and we are now empowered to enforce collection. If you have any dispute about this debt it must be put in writing and where relecant supported by documentary evidence. Our call centre cannot resolve any disputes over the telephone.

Yours faithfully

Payments must be sent to collect services limited, do not resolve any disputes over the telephone blah blah.

Thing is she spoke to DVLA they had her address down so she had received nothing from them, this is the first she has heard of it, she does not remember any offence as such and there is no date or time etc of the alleged incident.

Though they do have an address and a personal visits time.

The DVLA had her house number wrong they had put 27 instead of 270.

Any ideas?

Is this for a parking contravention? Do they state the date of the contravention?

I just looked again the date is April 21st 2009 they do not state what the contravention is.

She's on the phone to Reading council now so hopefully they will have some more insight. Also she has looked at her diary for that day last year and had 2 tutorials and a meeting so would of been likely to have been in uni all day and cannot think of a reason that she would of been at the station.

Sounds like chancers to me.

I had a final warning from Hounslow Council demanding that I paid them for an outstanding parking fine. I asked them for the photograph of my car and I never heard from them again.

You're friend is doing the right thing by speaking to the council.

im guessing looking at the letter they are claiming she has driven into the bus/taxi only part of station road.

It could also be the small piece of road between the station and Apex Plaze. That's a notorious place to get ticketed for stopping no matter how briefly - I think it's even been on national telly at some point.

That would be my guess, they have cameras there that will record if you stop, you have to be personally ticketed! A few years back I stopped there to pick up and got the ticket in the post. If its been outstanding since April 09 that would maybe explain the amount of fine involved.

This was on local news last week. You only have to stop to drop off or pick up and they take a picture of your reg, then request from the DVLA your details and the ticket arrives.
The reported piece of road at Reading station was private and therefore the council have no say. There are small yellow signs in place warning motorists, but impossible to read from your car. The reporter did say that although some motorists have opted for the court option, the company in question have never persued it as this costs more than they are likely to gain and the practise is questionable and if a magistrate rules against them then they will have no future business.

I personally would opt for a hearing and get them to justify the fine.

Thanks very much. I have told her to write a letter to the council and also the company asking for photo's (they also offered a dvd recording lol!) and when they follow up I will post the reply up on here and perhaps one of you lovely people could help me draft out a scary letter for the buggers? smile

I saw this on telly as well! They even ticketed someone who stopped to read the warning sign ffs!

The legal eagle they interviewed questioned their powers of authority and suggested if anyone took them to court then it'd end in the motorists favour, if it even went that far...

The angle on this is that the fine has to be appropriate to the offence.

If it is the station there are signs all over the place saying that if you stop you will be fined; but the fine has to be appropriate and they can be challenged if it can be proven to be inappropriate.

There may be some difficulty in arguing the fine because the warning is there, but that fine then has to be properly served on the person who has committed the offence, there has to be reasonable time to pay and it cannot be excessive.

I posted in here, or on pepipoo about this exact location as my missus bloody got me a fine by driving my car through here.
I was telling a mate who said (as you have) it is absolutely notorious for it.
IMO, don't ignore the notice.

This looks like it is a fine from Reading Borough Council for driving along Station Approach (the direction is given in the letter). The short section of road between the roundabout and the bus station is taxi/bus only and has cameras protecting it. Google maps

This is not a private matter from parking outside Apex Plaza (land owned by Prudential IIRC).
