Some of you will no doubt have read the recent threads about Magnecor leads and the comments I made at the time.

Phil de Wit the MD of Magnecor has threatened to take legal action over my comments, therefore in order to set the record straight Phil has asked me to issue this statement. It is copied directly and in it's entirety from the e-mail sent to me today.

"It has been brought to my attention that some of the statements which I made in the recent

Magnecor Ht lead thread on [10th August 2005], in particular regarding the quality of

Magnecor Europe Limited's products, were both inaccurate and inappropriate. Accordingly, I

wish to clarify my comments.


Whilst it is true that I have had four Magnecor lead sets reported as faulty by my

customers, I do not have any evidence that they were in fact faulty. I did not report any of

the four faulty leads to ACT or to Magnecor. I did not personally test the leads and I have

no evidence that the leads themselves were faulty. It is entirely possible that the problems

encountered by my customers were related to incorrect fitting or to other problems connected

with the customer's ignition system.


I confirm that I did not offer Magnecor the opportunity to carry out the appropriate testing

of the relevant lead sets. I am aware that one of the four customers has since approached

Magnecor directly with his alleged faulty leads. I have been advised by Magnecor that these

leads have been extensively tested and no fault has been found.


I suggested in my posting that, if you have ignition-related problems, you should check your

Magnecor leads carefully. This may have incorrectly implied that this was the most likely

cause of such problems for which I apologise to Magnecor. I should have, and do so now, make

clear that Ht leads (of any brand) are just one part of the total ignition system and equal

importance should be paid to each and every aspect of the system during fault diagnosis.


I also stated that there were "far too many of these faulty sets floating around" and that

there were likely to be hundreds of faulty sets across the tvr network. I retract this

statement unreservedly as I have no evidence of this being the case. I am not aware of any

other faulty Magnecor sets or of this being a larger problem. To the best of my knowledge,

all other Magnecor sets, which I have sold in the past, were in perfect condition and are

still fully functioning.


The dispute I have had with Tim at ACT is in no way connected to Magnecor and I apologise if

Magnecor have suffered any loss or damage to their excellent reputation as a market leader

in the manufacture of ignition leads. I would like to apologise unreservedly to Magnecor for

any inconvenience caused or loss suffered as a result of my previous inaccurate comments and

for not making these points clearer in the original posting".

Well. I recently had a new set of Magnecor leads and I have since changed them for a set of Lucas ones which are, in my opinion, far better.

Interesting.

So does this statement infer that many TVR dealers and specialists are unable to fit components correctly...?

Y'know, the more involved I get with TVR's the more I dislike all the aggressiveness amongst companies and owners that "support" them as a marque.

What a load of shite.

How dare this MD of Magnacore go around threatening to take legal action on a forum.

Next thing you know, everyone will want to take legal action.

I receive legal letters all the time, just pass them over to my barristers, 99.9% of the time they aint got a case and a half and are just pushing their weight, and you can take them to court for the obvious.

This is the UK, things work a little 'better' for the honest man. Freakin 'sueing shite' belongs over in the US where you cant say anything against anyone in fear of getting your pants sued off ya....

Pathetic.....

I don't know how that works Pod. The statement is to address the issues raised before, and the subsequent legal threat towards me. I am more than happy to issue this statement to set the record straight towards magnecor. It was written by Mr de Witt via their legal department and mailed to me by Mr de Witt so I guess if anybody thinks they've been unfairly maligned with regards their ability to fit leads they should take it up with the legal dept responsible for writing it? Maybe a PH lawyer can set this straight?

As far as i am concerned the statement is to set the record straight as regards the leads themselves and I wish to make it clear that I myself am not calling into question the lead-fitting ability of anybody.

The statement is a copy and paste, it's what Mr de Witt asked me to post therefore complies with everything the magnecor legal dept asked of me.

Phew, it's a minefield this isn't it? Big respect to any lawyers out there

Just supposing the comment that were made were unfounded and had a negative impact on sales of a product. Surely the manufacturer of that product should seek to have their reputation cleared, or the loss in sales compensated for?

Don't get me wrong, Jools is great and his knowledge, skill and enthusiasm for the marque cannot be doubted. He's also got a reputation for great customer service, which I've witnessed first hand.

However, the no naming and shaming policy on this site is designed to avoid any legal issues, like this one! If Jools or anyone breaks those rules and finds themselves in trouble (then chooses to retract their previous comments) then surely it's hardly fair to take another swipe at the company for protecting their business?
