TVR Deposit Refunds....

Now before I start can I just say that I love TVR cars, but......
Putting down a deposit at the Motorshow 2 years ago for a new Tuscan MKII Convertible seemed like a good idea at the time. However due to a change in my circumstances I decided to cancel my order and ask for my deposit back.
Now firstly I called TVR (Blackpool) and I was told that the deposit was not refundable. LIE!
After further investigation/conversations with various people I found that the deposit was indeed refundable and so I wrote to TVR, once, twice, three, four times and more asking for my refund........I heard nothing, not a sausage, not a whisper!
In the end I put in a claim with the small claims court. They didn't even bother responding to the court summons and so the courts found in my favour. Eventually after bailiffs had been instructed a cheque arrived on the doormat for the amount plus court costs owed!
Absolute genius TVR, well done! A* Customer Service.

mongoose said:I thought this was the case too - certainly I put my deposit down on the Sagaris at MPH 03 with the understanding that if I decided not to go ahead with ordering the car, I wouldn't get the money back.

A deposit is refundable unless the paper work you sign states otherwise. Also a deposit is refundable no matter what you sign, if you can prove the otherside has borken the contract.
It's possible that when they weren't refundable before that, the paperwork wasn't legally correct or it simply wasn't stated, so despite the fact the money was already in their coffers, it was legally still for the depositeers.

I'm sorry....so you think that it is perfectly acceptable for TVR to not reply to repeated letters from a TVR owner who decides they cannot go ahead with a new purchase?!
