work on tues do I turn up?
Discussion
I am being asked by quite a few monthly paid staff do I turn up on Tuesday if I have not had a letter?
The answer to this is simple If you have no official letter to say stay away you still need your position clarified .I will turn up if I do not get an official letter .I am also being told a few members of staff have had phone calls from the management telling them to stay away may I reminded the management you NO LONGER CONTROLE THE COMPANY and it is not your place to contact any member of staff directing them in such a manner this is now up to the receivers to do not management OOOOH Wait a mo I to have had a phone call telling me stay away management claimed they are acting under instruction from the receivers I FOR ONE WILL TURN UP ON TUESDAY I WILL TAKE A BOOK AND ANYBODY WHO TURNS UP I WILL PUT IN THE BOOK SO ALL CAN STAND AS A WITNESS FOR EACH OTHER THAT WE DID ATTEND

Gerbil, I would think it would be a good idea to keep a "diary" of events and meetings for reference at this point. Not only will you have a clear rcord of events for yourself should it ever be needed but it will one day be a very useful tool for whoever eventually ends up writing the definitive book about the demise of TVR.

If the management have no control now, the whole workforce should all turn up as TVR/BA cannot tell us any more. we need some answers.

Do you mean a joke book. At present you have a contract of employment. It appears, and only appears, that your contract ( and everyone else's) is in danger of being reached by Blackpool Automotive - who, I understand, employ the workforce. It is at present unclear who the management of the company are and whilst there may be people phoning people and telling them not to turn up it is by no means clear that they are authorised to do so.
You have had no written instructions
If you fail to turn on Tuesday you might be held to have breached your contract yourself- which you absolutely don't want to do in these difficult times. So -remember the first rule, if there is doubt, there is no doubt. If you're not sure - turn up - the worst that can happen is you find yourself locked out and have to go home, but you will not have done anything to breach your contract.

I believe the letters should have been sent out by TVR management not PKF, to all staff/workforce, however they again failed in there responsibilty. (the letters were drafted on the fateful friday by the administrators)
Subsequently, I received a phone call at 14.55 hours today from TVR accounts whom are presently ringing up all persons whom have not had a letter telling them not to turn up for work on tuesday. !!
Obviously the administrators do not want a confrontation in having to answer the workforce !!

Absolutely, keep a diary of every conversation and letter, including a written record of every conversation noting the date/time and who was involved, make it as close to a word for word transcript as you can. Also assume that anything said to you that is not in writing is worthless and will be retracted if it proves inconvenient. You are still employed unless they have told you in writing that your employment has been terminated at a specific date, in which case you should make yourself available to work. If you fail to do this then you may compromise your right to payment in lieu of notice and/or payment for acrued holiday not taken etc.

Do you mean a joke book. Sadly not. I seriously think that there is an important story to be told about the last 3-4 yrs of TVR. From prior to sale by PW to where we are today has been a saga that if you were to make it up as fiction, few would believe.
TVR has been such an important part of the British Automotive landscape that its story deserves to be told properly to enable everybody interested to understand the whys and hows.
The other major benefit a book like this would have would be to bring those responsible into the spotlight although I fear that the TVR world is so inter-related that many of the personalities involved would fight shy of actually being completely candid.
From an outsiders point of view (and I freely admit to being a TVR watcher as opposed to enthusiast or owner or even prospective owner - not my thing thanks) this past year has been like watching a family dissolve into civil war. Horrific at times yet horribly fascinating.
So, on the off chance that one day someone is daft enough to actually try and put all this into a book, it would be extremely useful to have contemporary records from people involved as opposed to distant memories of who said what to whom and when. For someone like Gerbil, who has given so much to TVR over the years, it may yet be a way of having his voice heard, even if right now it seems pretty pointless.
Any journalists out there fancy a project?.
I'd agree with turning up and recording everything said and done. Do not take verbal notification, insist on the written word everytime. DO NOT be obstructive, but be firm.
Daft question did your employment contract get transferred across to BA or is it still with TVR Engineering. If it was transferred did you agree and sign a new contract
or are they 'assuming' you work for BA because they set up the BA company ready for the fall
, in which case I would say BA have no right to terminate your employment as you don't work for them. Feel free to correct me if I've got the companies wrong etc as I haven't followed the full saga.

I also understand this should have been done.

It became BA on 23/5/06. It's all the same company? (And it's accounts are overdue for filing........

I do not doubt the union will be pursuing this avenue post haste. Can't believe anything could be so badly managed. Live and learn.........
Anyone who was employed by TVR Engineering will not have had new contracts as the change of name to Blackpool Automotive Limited does not change the legal entity who entered into the contract.
It was only a change of name, not a change of employer
Unless someone with authority to speak on the part of the company (ie Blackpool Automotive Limited) puts it in writing the best thing to do would be turn up on Tuesday to avoid any allegation that you are in breach of your contract. Keep the moral high ground.

Simply, unless you have a new contract with any of these satellite companies that were established, you must, I assume by default, be still employed by the parent company what ever that is, which I assume is not the one going under
.
Again unions have legal departments who should be looking into this side of it.

Hello to all concerned,I fully agree to turn up Tuesday morning, this was told to us by 'A' Director! I have not recieved one of the above mentioned telephone calls......Odd way to be told by a 'phonecall'. I would prefer to have written proof, rather than be shot in the back further.....The none payment of a monthly wage that I and the others have worked for, does not head for a Happy New Year. At least turning up on Tuesday,I could live in hope to recieve my wages,I find talking face to face would help a little, infact any advice personnally would be great....Fed up from hearing from the Press and websites!
Anyone else?????????
