If you paint over rust, it will return very quickly. Even if it's treated, it will return. Only answer is to cut it out unfortunately.

No it's not right in any way, shape or form. But depends very much on what your brief was to the garage as to whether you could reasonably have expected a better job......i.e did they cost the work without budget guidance from you or were they working to a budget set by you.
The reason I ask is that £3400 really doesn't sound anywhere near enough to do a 'proper' body restoration.
Need more info to give more accurate advice really.

There are at least two other threads running on this subject.
I'll say what I said before on one of your other threads - having seen your pics of the vehicle in its original condition - and that was that it was badly rusted. A wire brushing plus a bit of filler & paint aren't going to sort that out.
If any of the metal is perforated or corrosion is in folded or crimped areas then rust is going to reappear very quickly - esp once into wet weather. Only cure is to replace with new panels.
I wish you luck with the court action you are proposing.
