I was under the impression that images could not be used for prosecution, unless permission was given by the person that was the picture. I heard this about CCTV some time back.

They probably asked the thicko "...if we managed to get photo's of you doing the crime and since you adamantly say you didn't do it then you wouldn't mind us using the photo's during the prosecution?"

He'd either confess or if he sticks with the "I never done it guv" they'll use them, either way he's caught.
