Whilst I feel sorry for him that he has been permanently damaged by this fall, it was his own fault at the end of the day and he shouldn't have been on the roof.

On the evening of the accident Stephen, then aged 12, went up on to a flat roof, using apparatus attached to the side of the building, to retrieve a football, but fell through a skylight. Stephen's case was that the council failed to take reasonable care to ensure his safety. The authority, in contesting the claim, said that he was no longer a member of the club as his annual £1 subscription had expired and he was therefore a "trespasser" at the time of the accident. It also argued that it "must be beyond question" that the boy knew that the roof was "out of bounds". Stephen is now said to have "no capacity whatever for future paid employment".
