Whilst I feel sorry for him that he has been permanently damaged by this fall, it was his own fault at the end of the day and he shouldn't have been on the roof.

Stephen Young, of Skeynes Road, Edenbridge, Kent, was attending a youth club at the time of the tragedy in February 2001 which has left him mentally disabled with severe behavioural problems.

Through his mother Debbie, the teenager sued Kent County Council, which ran the Astor Youth Club in the grounds of Eden Valley School in Edenbridge.

The council denied liability for the accident and Mr Justice Morison, sitting in London, was asked to rule on that aspect only of the case at this stage.

The judge, who visited the site of the accident during the case, ruled that the teenager is entitled to damages.

But he ruled that any figure which will be assessed at a later date must be reduced by 50% to reflect Stephen's contributory negligence for the accident.

On the evening of the accident Stephen, then aged 12, went up on to a flat roof, using apparatus attached to the side of the building, to retrieve a football, but fell through a skylight.

Stephen's case was that the council failed to take reasonable care to ensure his safety.

The authority, in contesting the claim, said that he was no longer a member of the club as his annual £1 subscription had expired and he was therefore a "trespasser" at the time of the accident. It also argued that it "must be beyond question" that the boy knew that the roof was "out of bounds".

Stephen is now said to have "no capacity whatever for future paid employment".
