US court dismisses sex lawsuit by male CBS worker
Tue Nov 1, 2005 9:29 PM ET

SAN FRANCISCO (Reuters) - A split U.S. appeals court dismissed a lawsuit on Tuesday in which a male CBS TV station employee alleged sexual harassment by a female manager who offered him oral sex and "life-altering" intercourse.

The case involves Hugh Hardage, who worked as an advertising executive for Washington state's KSTW-TV, owned by Viacom Inc., starting in 1998. In a lawsuit, Hardage, who resigned in 2001, alleged that General Manager Kathy Sparks made unwelcome sexual advances on several occasions.

When Hardage complained to sales manager Patty Dean, he said she responded: "Why don't you just do it and get it over with? It may put her in a better mood." But Dean also set up an investigation of the alleged abuse.

A three-judge panel of the 9th Circuit Court of Appeals said even if the remark was unfortunate, CBS acted properly overall, and it affirmed a lower court dismissal of the suit.

"Dean's alleged comment to Hardage that 'Why don't you just do it and get it over with. It may put her in a better mood' is certainly troubling," Judge Clifford Wallace wrote. But "considering the 'overall picture,' CBS's response was both prompt and reasonable as a matter of law."

In a partial dissent, Judge Richard Paez said CBS did not properly investigate the alleged abuses.

"It is difficult to imagine how any reasonable juror could conclude that an employer who suggests that the complainant have sex with a harassing supervisor has acted reasonably to end the harassment," he wrote.

Never understood these sort of men, who moan about sexual harrasment.

If she's fit, sh*g it, if not tell her to p*ss off, But how many men would go to a tribunal over it.

Dunno, I can sort of see what you're saying but surely if the attention's unwanted then it's harrassment? And as is often pointed out on here, some female managers can be psycho bitches from Hell and don't take rejection lying down (as it were)...

My post was partly tongue in cheek, I could do with some sexual harrasment .

More seriously, I think men should be able to deal with such problems without involving the courts. I think you can take equality too far.

Not a great approach if she's your boss, and the harrassment/not giving in is damaging to your career.

I'm a little shocked by this story, actually - his female line manager's comment (paraphrased: "why don't you just do it" would have been completely unacceptable had their genders been reversed...

I think everyone should be able to. Though my friend who was sexually harrassed by her boss took her revenge by peeing in his coffee and then telling everyone after she'd left.

But in the US thats what some(or should i say most, but not all) do,sue everyone they can for the smallest things, in the hoping that they will become "well off" by it.

Not everybody is as forthright as you are.

I've been on the receiving end of sexual harrassment at work when I was younger and told my boss very loudly that if he touched my backside once more then he'd be needing a dental surgeon to put his teeth back in place. He stopped doing it, but he made my life hell and I ended up leaving.

There can be a fine line with some people as to what you can and can't say, and how far you can take banter. Alot of people (too many in my opinion) are too polite to say when someone is overstepping the mark (which is different for each person) so they get bullied or are too embarrassed to say something when someone is making inappropriate comments or acting in a way that makes them uncomfortable.

I reckon
1st he was not well endowed and felt embarrassed about it just in case the rumours spread around the tv station.
2nd maybe he was wearing women's underwear and did not want his boss finding out about it.
3rd the above two + could not get it up.
Jokin apart , if he was single and got offered a BJ by his female boss, it should be seen as a compliment and in some cases better than promotion .The worse he could do is say NO , there is no serious need for court action.
A slapper boss is better than an old git , at least for morale's sake. Imagine that ! every morning you look forward to going to work, and have your rocket polished for good measure.
Ok now I am ready for the backlash from the all politically correct lot lol
