wrongly named 'broken law' on penalty notice
Discussion
Well, I got my first Penalty Notice ever - for an unpaid Prescription Charge for goodness' sake!!!
Thing is, I have the receipt from when the prescription was 'filled' (October 2005), but my mum collected and the nice lady behind the counter said "Ooh, does he pay for his prescriptions nowadays? Fancy that!". I am confident I can get them to back off
.
Anyway, I noticed that they refer to "The NHS (Penalty Charge Regulations) 1999" on the Penalty Notice - but as per the "Statutory Instruments" website (thanks for the inspiration about this stuff, Dwight Van Driver
) it should say "The National Health Service (Penalty Charge) Regulations 1999". Pedantic or what?
I'm not fussed about their use of "NHS" as an abbreviation, it's the misplaced 'closing bracket' that caught my eye.
Is a misplaced bracket enough to kill this one off at source?
Suggestions before I write to them, please
.
Rich.
PS If this is in the wrong forum - apologies

I know of the 'Bill of Rights' but it doesn't seem to be being taken on board as an argument against this kind of nonsense. Good comment though - no reference is made to anything other than paying the Penalty Charge or 'Penalty Charge plus Surcharge' after 28 days has elapsed.
I am only not liable if I can prove I was exempt from paying the Prescription Charge at the time, if someone else who is jointly and severally liable pays the penalty for me, and something else I can't remember (all this is stated on the Notice which is at home, and I am at work - D'oh!).
I will add the 'Bill of Rights' comment to my proposed letter, so thanks for that.
Am I on a hiding to nothing in saying that they have stated the relevant Act's Title wrongly, so I am disregarding the Notice?
Cheers,
Rich.
