Havn't seen a thread this morning for a problem with agents/landlords/tenants so I thought I do the honour smile

Essentially we moved out of the house in May and still do not have our deposit back. The landlord is not happy with the way the house was left and has subsequently gutted it! A vastly inflated bill of works was shown to us by the agents (who agree it was nonsense) however we have yet to hear anything further. Despite letters being sent to the landlord by the agent we have heard nothing.

Naturally I am disputing the claim so I am quite happy for it to go to tribunal as I thought the landlord would be, however if he has gone awol how can we get our money back? It is being held by the deposit protection scheme currently.

The agent should be able to advise on how to contact the Deposit Scheme and launch an action against the landlord.

Don't forget to mention in any claim that the agent has verbally agreed that the landlord's claims and behaviour are irregular

No smile

Of course I am going to say that but in this instance it is true.

An example being that in the utility room the paint started flaking off near the ceiling. It was claimed that this was caused by 'excessive heat due to poor ventilation when tumble dryer running', all very well if we had a tumble dryer..

You will have some sort of refernce from the scheme where your deposit is held why not give them a call and ask for advice.

In any case the landlord has not got any of the deposit either.
