yes

The whole "contract" should be set out on the signs. If they don't mention any more than an unclamping fee then that's all they can do.

Threaten to report it as stolen. Also, check the person who clamped and towed has an SIA license, as working without one is highly illegal.

The signage MUST:

  • Show a method of release- ie a contact number which is 24hours
  • Must show a price in £ for the release
  • The employee MUST wear his SIA badge at all times
  • Their signage MUST be clearly visible over all areas of the car park.
Theres more but |Im pissed sorry. Look up SIA Clamping and see what the regs are.

Good luck smile

How do you know it hasn't 'just' been stolen?

Did they leave a note laying where the car was stolen from was parked?

Was it on council land or private land? If on private land, check out this thread

Write to them and advise that they are interfered with your chattels with no legal right to do so. Take a photo of the sign which makes no mention of the removal of any vehicle.

Turn up, write a cheque for any amount they ask, when they refuse the cheque then phone the police saying you have caught a robber.

when the police turn up and force them to accept the cheque then drive your car away. Phone bank, stop cheque.

Now a civil matter and they will have to pursue you through the courts!

It's already a 100% civil matter and nothing to do with the Police.

To the OP, sorry to hear this, and I would check the car inch by inch before driving away, jus in case it's been damaged.

Unfortunately most places like that wont accept cheques for that exact reason

You'd like to think that if he's an old mate he'll just give you the car back. Then again people don't really seem to be that way inclined anymore unfortunately....

If there is no sign permitting removal then a private prosecution for theft will be good.

fk them! They've illegally taken your car in breach of the contract (as per the clampers sign stating clamping only) and now you're about to give them £120 as well. You must be soft. They'd be getting the sharp end of my tongue and a letter from my solicitor.

He needs to get the car back tho..... gently, gently, catchee monkey - read on wink

thumbup Good to hear he is reasonable biggrin

However, get a photo of the signeage and post it up, will help the lawyers (who work very hard so need a weekend sleep in to recover) when they get here later hehe

Take the photo of the sign with you. Reducing the fee as it was a contractor is all very good, but he should be fining his contractor IF it doesn't say anything on the sign about removal - that there contractor could lose him his licence!!!

key point of "theft" is "intent to permanantly deprive" there is no intent to do this therfore no theft has occured they are and always have been perfectly happy to give the car back in exchange for a penalty charge.

No it's not theft, but is it possibly an offence equivalent to kidnap; maybe demanding money with menaces? i.e. pay up or we'll keep increasing the "ransom" and eventually sell your car and trouser the money. bds!

Make sure you ring, or email Ed Doolan on radio WM about this. He's got a very big bee in his bonnet about clampers, and wants everybody who is clamped to call him, and he's going to ring your MP EVERYtime it happens untill they get pissed off with it and change the law.
